SAP is seeking a Senior LegalCounsel to work within its field legal organization in the Asia Pacific (“APAC”) region. Based in Malaysia, you will be a part of the APAC legal team and will provide legal expertise for SAP and its business teams, particularly SAP’s sales teams, across the region.

The Role
  • Provide legal advice and support for SAP’s licence, cloud and field services sales organizations for SAP’s market and business units in APAC.
  • Independently draft and act as primary negotiator for cloud services, software licensing and support services contracts, data processing agreements, distributorship and partnership agreements with SAP’s customers in the private and government sectors and partners; respond to RFPs and tender documents.
  • Collaborate with other APAC legal colleagues and with sales and services executives, SAP’s sales management, product, pricing, revenue recognition and bid management teams, and other stakeholders in a time-pressured environment to achieve SAP’s objectives in accordance with SAP policies and applicable laws.
  • Provide legal counselling on matters including management of claims, disputes and litigation; intellectual property; licensing; data privacy; license compliance; and employment issues. Experience in the Cloud (SaaS) sector is strongly preferred.
  • Lead structuring of complex transactions and draft/ negotiate terms with customers in private and government sectors for SAP’s Cloud, Software, and Services businesses.
  • Work with Internal Sales, Pricing, and Revenue Recognition teams during drafting and negotiation; assist with legal escalations related to transactions.
  • Balance legal risks against commercial objectives to act as a true business partner; identify contractual risks and suggest alternatives for optimal solutions.
  • Ensure contractual terms comply with legal, regulatory, and company policies; integrate legal, business, technical and practical analysis.
  • Assist in handling field and corporate legal matters, including bid management, employment, privacy, intellectual property rights, and claims and disputes management; participate in special projects as assigned.
Role Requirements
  • Graduation from an accredited law school
  • Licensed to practice law in a commonwealth jurisdiction
  • 7–8 years of legal experience in applicable areas of the law, gained in a reputable law firm and/or in-house environment
  • Preference for experience negotiating Cloud Agreements (data protection, data analysis, security, regulatory/compliance, liability terms) and for RFP responses for public sector customers; HR matters including HR litigation and regulatory topics such as data localisation, data privacy and local content requirements
  • Strong relationship-building, leadership and communication skills, in written and spoken English
  • Creative problem-solver who can think outside the box while adhering to guidelines within SAP’s risk and compliance framework
