This is the most critical part of the role in Malaysia. You are responsible for ensuring the company "keeps its doors open" by managing:
Securing and renewing Premise and Signboard licenses from local councils (e.g., DBKL, MBPJ, MBSA).
Ensuring compliance with the Food Act 1983 and Food Hygiene Regulations 2009. This includes verifying that all staff have valid Typhoid vaccinations and Food Handler training certificates.
Liaising with JAKIM or state departments (JAIN) to obtain and maintain Halal status, which is often commercially vital in Malaysia.
Managing the company's profile on the FoSIM (Food Safety Information System of Malaysia) portal.
Catering is a B2B and B2C heavy industry. Your scope includes drafting and reviewing:
Ensuring clear terms for corporate catering, wedding events, and long-term canteen management contracts (including indemnity and cancellation clauses).
Drafting agreements with raw material suppliers, logistics providers, and cold-chain warehouses.
Managing leases for central kitchens, office spaces, or retail outlets.
Labor Laws: Advising on the Employment Act 1955 (including recent amendments), specifically regarding overtime, public holiday pay for kitchen staff, and foreign worker quotas/levies.
Secretarial Matters: Working with the Company Secretary to file annual returns and maintain board minutes.
Intellectual Property: Protecting the company’s brand, unique recipes (as trade secrets), and trademarking logos/sub-brands.
Customer Claims: Handling legal responses to food poisoning allegations or breach of contract claims from disgruntled clients.
Debt Recovery: Managing the legal process for recovering unpaid invoices from corporate clients or event organizers.
External Counsel: Managing and instructing outside law firms if a matter proceeds to litigation or arbitration.
