Job summary

A leading electrical and machinery firm in Malaysia seeks a Contract Manager responsible for overseeing contract and commercial matters across its divisions. The role demands extensive experience in construction contract management, strong negotiation and analytical skills, and the ability to manage contractual risks effectively. Key responsibilities include leading contract administration, managing variations and claims, and collaborating closely with Project Managers and legal advisors. Qualifications

  • Minimum 8–12 years experience in construction contract management.
  • Strong exposure to Data Center, M&E, or Renewable Energy projects preferred.
  • Familiar with standard forms of contract (PAM, CIDB, bespoke contracts).

  • Oversee contract administration from pre-award to final account closure.
  • Manage and evaluate variation orders, claims, and disputes.
  • Prepare regular commercial reports highlighting risks and claims exposure.

Position Summary

The Contract Manager is responsible for overseeing all contract, commercial, and contractual risk matters across three divisions of the company. This role ensures contracts are properly administered, variations are controlled, claims are managed, and commercial interests of the company are protected throughout the project lifecycle.

The role works closely with Project Managers, QS, Finance, Procurement, and Legal advisors.

Key Responsibilities (Common Across All Divisions)
Contract Administration & Governance
  • Lead contract administration from pre-contract award to final account closure.
  • Interpret contract terms (LOA, main contract, subcontract, consultancy agreements).
  • Ensure compliance with contract conditions, employer requirements, and project specifications.
  • Maintain proper contract documentation, correspondence, and records.
  • Review tender documents, contract conditions, risk clauses, and commercial terms.
  • Identify contractual risks and provide mitigation strategies before award.
  • Support management during contract negotiations with clients, consultants, and subcontractors.
  • Manage and evaluate variation orders (VO), EOT, claims, and counter-claims.
  • Prepare, review, and substantiate claims with contractual and factual support.
  • Coordinate with QS and Project Team to ensure timely submission and recovery.
  • Monitor final account status and commercial exposure.
  • Review and advise on subcontract agreements and purchase orders.
  • Ensure back-to-back contractual protection with subcontractors.
  • Manage subcontractor claims, variations, disputes, and payment issues.
Risk, Dispute & Compliance Management
  • Identify potential contractual disputes early and advise on preventive actions.
  • Support dispute resolution, negotiations, mediation, or adjudication when required.
  • Liaise with Legal Advisors when necessary.
  • Ensure compliance with company policies, audit requirements, and ISO standards.
Reporting & Management Support
  • Prepare regular commercial status reports for management.
  • Highlight risks, claims exposure, and recovery forecasts.
  • Provide contractual advice to Project Directors, PMs, and Senior Management.
Division‑Specific Responsibilities
A. Data Center Division
  • Handle complex contracts involving international clients, hyperscalers, and main contractors.
  • Manage strict compliance requirements, milestone‑based payments, and high‑value variations.
  • Support coordination with multi‑disciplinary packages (CSA, M&E, IT, testing & commissioning).
  • Ensure tight control on contractual timelines, EOTs, and delay risks.
B. M&E Division
  • Manage contracts related to HVAC, electrical systems, ELV, gensets, and infrastructure works.
  • Handle technical variations, scope gaps, and coordination claims.
  • Support site teams on contract interpretation related to installation, testing, and commissioning.
C. Solar / Renewable Energy Division
  • Manage EPC, supply, and installation contracts for solar projects.
  • Support PPA, performance obligations, LDs, and energy output‑related clauses.
  • Handle claims related to authority approvals, grid connection delays, and design changes.
Requirements & Qualifications
  • Bachelor’s Degree in Quantity Surveying, Construction Management, Engineering, or Law.
  • Minimum 8–12 years experience in construction contract management.
  • Strong exposure to Data Center, M&E, or Renewable Energy projects preferred.
  • Familiar with standard forms of contract (e.g. PAM, CIDB, bespoke contracts).
  • Strong negotiation, analytical, and contractual writing skills.
  • Able to work independently and advise senior management confidently.
