College of Psychologists and Behaviour Analysts of Ontario

The College of Psychologists and Behaviour Analysts of Ontario is the governing body for Psychologists, Psychological Associates and Applied Behaviour Analysts in Ontario. The College’s role is to regulate the provision of services in the public interest by setting the standards for competent and ethical practice.

The College is seeking to hire a full-time Investigations and Resolutions Case Manager. The ideal candidate has demonstrated superior oral and written communication skills, the ability to distill and effectively address the key issues in complex situations.

KEY RESPONSIBILITIES
Inquiries and Informal Resolutions

  • Assists in responding to telephone, e-mail, and mail inquiries regarding concerns about
    members’ conduct, competence and/or capacity;
  • Makes judgments regarding whether the public interest or relevant legislation requires a formal investigation or whether use of dispute resolution techniques would be appropriate;
  • Where a formal investigation may be required, prepares appropriate preliminary investigative information for either the Registrar or the Inquiries Complaints and Reports Committee (ICRC),
    for their review and direction, as required by the legislation.

Facilitated Resolutions

  • Where appropriate and in the public interest, provides information about the Facilitated Resolution Process to complainants and members (or their lawyers) and facilitates the resolution of formal complaints in accordance with relevant legislation and the College’s policies

Investigations

  • Reviews complaints and other information received by the College relating to possible misconduct, incompetence or incapacity and determine of the nature and scope of concerns;
  • Develops and executes an appropriate investigation strategy to obtain information relevant to the allegations;
  • Prepares investigative materials and reports for statutory committee members, organizes the materials according to the key issues, relevant regulations, and professional standards;
  • Oversees the preparation and distribution of materials for statutory Committees and ensures Committee members receive all relevant information;
  • Attends Committee meetings to provide background information on assigned cases and provide procedural and policy advice as appropriate
  • Records Committee discussion for incorporation into draft decisions and inclusion in the Committee minutes

Decision Drafting and Administration

  • Supports the Committee in its decision-making process by ensuring adequate and accurate reasons, clarity and consistency with administrative law principles, regulations, and standards of the profession;
  • Drafts decisions and/or liaises with decision drafters and oversees the review and signature of the decision by Committee members and ensures distribution of decision to the parties Health Professions Appeal and Review Board (HPARB) Reviews;
  • Coordinates responses to requests for HPARB reviews involving investigation files, ensures the release of the investigation record and that any issues around confidentiality are brought to the HPARB’s attention before disclosure to the parties;
  • Represents the College at HPARB reviews, reviews the file in advance and attends to address any questions about the College’s investigation, standards, or programs.
  • Disciplinary Matters
  • Creates draft Notices of Hearing and Agreed Statements of Fact, and assists College counsel in the preparation of materials for disclosure to member/member’s counsel;
  • Assists College counsel during hearings, when required;
  • Prepare articles for HeadLines describing the nature of the case and the Committee’s disposition, upon request.

General

  • Manages and maintains organized files and file systems relating to ongoing investigations and resolutions, including correspondence sent and received, documentation and information about steps undertaken, direction provided, results achieved;
  • Ensures preservation of evidence
  • Reviews files for storage
  • Assists with the drafting of policies, procedures and protocols relating to investigations and resolutions for review by the appropriate Committee or the Council;
  • Raises emerging issues for discussion within the College including issues arising in investigations and administration of the RHPA and Psychology Act;
  • Assists as needed in the preparation of Training/Orientation and Plenary Session materials and attends same if required by the Director and provides ideas and support to projects undertaken by the Committee members;
  • Assists statutory and non-statutory Committees as requested by the Director
  • Keeps abreast of trends in the practice of psychology, administrative law, and changes to relevant legislation.

Salary range $98,000 – $127,000
