The Information and Privacy Commissioner of Ontario is an administrative tribunal responsible for the Freedom of Information and Protection of Privacy Act (FIPPA), the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), the Personal Health Information Protection Act (PHIPA) and Part X of the Child, Youth and Family Services Act (CYFSA). Under these acts, the Information and Privacy Commissioner, Tribunal and Dispute Resolution Division resolves access to information appeals and complaints and investigates privacy matters. The IPC’s Investigation Department is currently recruiting for Mediator/Investigators. If you feel you are qualified, review and apply to this opportunity.

What can I expect to do in this role?

  1. Investigate privacy complaints made by members of the public under FIPPA, MFIPPA, PHIPA and CYFSA.
  2. Attempt to effect settlement of access complaints under PHIPA and CYFSA.
  3. Issue Mediator’s Reports / Investigation Reports summarizing mediation/investigation outcomes.
  4. Issue M/FIPPA Privacy Complaint Reports and PHIPA/CYFSA Decisions with findings and recommendations.
  5. Investigate and review certain complaints and self-reported health breach files under delegated decision-making authority.
  6. Improve customer service through participation in institution relations and public relations programs.
  7. Mediate and investigate complaints by: interpreting legislation, explaining rights, and determining applicability to access and correction rights.
  8. Explain the operation of FIPPA, MFIPPA, PHIPA and CYFSA to complainants; outline mediation/investigation processes.
  9. Investigate circumstances and gather facts surrounding complaints and self-reported or Commissioner-initiated privacy breaches.
  10. Attempt to resolve complaints through mediation; determine mediation strategies and approaches.
  11. Conduct research and analyze past precedents; apply precedents and internal policies to ongoing files.
  12. Whenever possible, provide advisory opinions on the likely outcome of the complaint.
  13. Complete all required documentation to process or close files.
  14. Act as a delegated decision maker under FIPPA, MFIPPA, PHIPA and CYFSA by preparing documentation soliciting written representations, analyzing precedents, and issuing written decisions/reports with reasons.

How do I qualify?

Knowledge
Demonstrated qualifications include:

  • Post-secondary education in a related field, or an equivalent combination of education and experience.
  • Proven investigation and mediation skills, including handling cybersecurity incidents and privacy matters involving government institutions, health information custodians, and service providers.
  • Understanding of administrative law concepts.
  • Understanding of the provisions and operation of FIPPA, MFIPPA, PHIPA and CYFSA.
  • Proven mediation skills and a customer service and resolution-oriented approach to conflict situations.
  • Strong understanding of computer technology and cybersecurity principles.

Interpersonal and Relationship Management Skills
Ability to establish effective working relationships with employees, management and both internal and external clients; ability to work independently and as a team member.

Analytical, Research and Project Management Experience
Well-developed analytical and problem-solving skills; ability to plan and conduct extensive research and prepare written reports, evaluations and recommendations; ability to identify risks and barriers during mediation/investigations.

Communication and Presentation Skills
Well-developed oral communication skills; strong written communication skills to prepare reports and decisions; experience using standard computer software applications to research and prepare materials.

Preferred Asset Qualifications
Ability to communicate (orally and in writing) in French.
