Role Summary

To maximise collections from defaulting clients, provide sound legal support to post-investments unit where there are emerging defaults on loan servicing. Active involvement in deal re-structuring, understand and analyse the commercial aspects of the transactions and give expert legal solutions.

Outputs
  • Maximise Legal collections from defaulting clients through negotiating payment arrangements and instituting legal proceedings in Court,
  • To provide sound legal support to post-investments unit where there are emerging defaults on loan servicing. Active involvement in deal re-structuring, understand and analyse the commercial aspects of transactions and give expert legal solutions,
  • To provide prompt and sound legal advice and support to the NEF in particular the Post Investments Department & Turnaround, Workouts and Restructuring department,
  • Manage budgets and relationships with external lawyers,
  • To address all legal matters relating to the NEF and its investee companies, implement amendments to funding structures and terms and negotiation of contracts with investee companies or third parties,
  • Provide general legal advice to the NEFs various departments,
  • Pursue criminal charges against investees and third parties who have committed fraud against the NEF,
  • Mentor Legal Advisors.
Recoveries
  • To provide legal input to submissions on existing investments prepared for the Portfolio Management Committee and other committees,
  • Implement Committee decisions to recover monies, ensure rights of NEF are protected,
  • Negotiate settlements,
  • Brief external attorneys,
  • To implement and monitor debt recovery, litigation, liquidation and all other legal and Court processes, whether or not outsourced to external law firms.
Turnarounds, Workouts, Restructures
  • Business rescue, turnarounds and restructuring.
  • Understand instruments, draft agreements, litigate, sequestrate.
  • To implement the restructuring of companies, draft and review all legal agreements relating thereto.
Experience / Skills Required
  • At least 5 years experience post articles experience in similar environment i.e. DFIs, Banks, Private equity, Private Legal Practice, etc.
  • At least 5 years litigation, business rescue and Court experience,
  • Experience in insolvency law,
  • Experience in commercial law,
  • Proven working knowledge of Corporate law and Tax law,
  • Business report writing,
  • MS Office suite knowledge,
  • Experience in Turnarounds, Workouts and Restructuring is advantageous,
  • Professional and courteous to all clients (internal and external),
  • Accuracy in preparing legal documentation,
  • Ability to advise on legal issues related to NEF business,
  • Ability to convey legal opinions and argue legally.
  • Attend to fraud and other criminal law related matters
