Purpose

This position principally reports to, and supports the Director, Head of Central Compliance, APAC, as well as other senior members of the APAC Central Compliance department in delivering the APAC Central Compliance program for the Global Banking and Markets, and Global Treasury (GBM&T), businesses in Asia Pacific in order to provide reasonable assurance that:

  • The firm and its employees comply with applicable securities regulatory requirements and internal policies and procedures.
  • The risk of reputational damage, regulatory sanction and discipline, client complaints and civil litigation is minimized.
  • Actual and potential compliance violations and risk situations are pro-actively identified, investigated and resolved or escalated in an appropriate and timely manner.
  • Undertake compliance reporting and regulatory reviews.

This position contributes to the overall success of the APAC Central Compliance Department and the GBM&T businesses in Asia Pacific ensuring specific individual goals, plans, and initiatives are executed / delivered in support of the team’s business strategies and objectives. Ensures all activities conducted are in compliance with governing regulations, internal policies and procedures.

Accountabilities

Supports the Manager/Senior Manager, Regulatory Change Management and Compliance Projects, APAC, and the Director, Head of Central Compliance, APAC, in facilitation of Global and Regional Compliance policy and procedures development, APAC Central Compliance initiatives, training processes, management reporting, regulatory projects management, and process optimization, with a view to regularly being able to establish strategies for optimizing internal operations, in the following key workstreams:

Regulatory Management
  • Responsible for managing the reporting process to Enterprise Office in relation to local governance committee papers on the implementation of the Compliance Risk Framework, and any other global or regional Compliance policies, as required.
  • Manage and coordinate the review process for Global and Regional Compliance policies, procedures, dispensations, and APAC Compliance country addenda.
  • Performance management and tracking of deliverables against the Global and APAC Compliance Plans.
  • Work with the Director, Conduct Incident and Breach Management, Monitoring, Testing and Surveillance, Central Compliance, APAC, to administer the Compliance Risk Appetite and reporting metrics, as well as manage and collate the Key Risk Indicator/Key Performance Indicator submissions from the APAC Compliance country teams.
  • Manage the development and updating of relevant policies, procedures, and processes in response to reporting requirements, as necessary. Responsible for tracking of review cycle of documents by creating workflows to manage approval requests and follow-ups to streamline the submission process for APAC Compliance.
  • Assist in the review and development of Compliance metrics specifically to gauge governance and control of regulatory reform management.
  • Collate, review, and manage (including providing quality control assurance) in the delivery of management information to key stakeholders.
Global Regulatory Relations, APAC
  • Oversees the Asia Pacific Regulatory Relations Group together with the Head of Regulatory Relations, Asia Pacific, which acts as the central point of contact with the Bank’s Asia Pacific regulators for their supervisory activities, including supporting the communications with regulators, regulatory reviews, examinations, continuous monitoring, and related deliverables and interactions.
  • Provides central oversight of progress on committed remediation work, including facilitating the understanding and, where required, clarification of regulators’ communications and agendas as well as providing assurance that the Bank’s responses to regulators are timely, coordinated, and appropriate. Provides regulatory response oversight and review of key supervisory and regulatory matters to Senior Management and committees, as appropriate.
  • Coordinates the Bank’s preparedness for new regulatory matters working closely with Asia Pacific Compliance, Businesses, Control Functions, Group Technology and Operations, BSA/AML and Legal as necessary.
  • Works closely with Regulatory Remediation and Reporting (based in Toronto) to support the remediation of the portfolio of commitments / issues from regulatory examinations to ensure timely closure and necessary follow-up.
  • Partner with relevant internal stakeholders to strategically manage Key Regulator relationships, serving as an effective and trusted liaison for regulatory compliance risk management.
  • Builds a fluid communication channel with Compliance Heads as a key partner of Country Compliance Teams.
Regulatory Change, Issues Management and Reporting

Assist the Manager/Senior Manager, Regulatory Change Management and Compliance Projects, APAC, as follows:

  • Keep abreast of APAC legislation and regulatory developments and assist with the preparation of regulatory change reports to keep management up to date on relevant legal and regulatory developments.
  • BAU management of the APAC Regulatory Change Management Framework, including providing internal training and attending to queries from APAC Compliance in the application of the Framework.
  • Responding to queries from Enterprise teams on APAC regulatory changes and to work with relevant APAC Country Compliance Heads to resolve issues identified.
  • Act as back-up in coordinating for APAC Compliance Risk and Control Assessments (CRCA) program
  • Maintain and coordinate internal reporting workflows and perform quality control review for the following:
    • Management reporting to regional and global office and governance process
    • Global Information Management System (GIMS), Regulatory Change Management and Regulatory Library Maintenance on Microsoft OpenPages
    • GBM and GT Compliance and Operational (CORE) Risk Reporting
    • Chief Compliance Officer (CCO) Reporting
    • Global Regulatory Relations Reporting
    • Core Risk Asia Pacific Committee (CoRA) Reporting APAC Central Compliance
    • APAC Associated Persons (AP) Governance Report
    • Regulatory Oversight Committee (ROC) Report
    • GBM & GT Business Heads Update Reporting
    • Any other ad-hoc reporting requirements from GBM&T Compliance in Enterprise Office and Regional Office.
Technology Compliance
  • Act as the bridge between APAC and the Global stakeholders/teams for updates relating to the Enterprise approach for Technology Compliance matters.
  • Assist and coordinate with the Head, Global Regulatory Relations, and Technology Compliance, APAC in order to ensure business strategies, plans and initiatives are executed and delivered in compliance with governing regulations, ethical conduct, internal policies, and procedures.
  • Be familiar with the Scotiabank Privacy Risk Management Framework, to coordinate Privacy Impact Assessments (PIAs) for data and information technology related initiatives/projects/contracts for APAC, as well as on a Global basis utilizing personal data in line with Bank’s PIA Procedures.
General Accountabilities
  • Champions a customer focused culture to deepen client relationships and leverage broader Bank relationships, systems, and knowledge.
  • Understand how the Bank’s risk appetite and risk culture should be considered in day-to-day activities and decisions.
  • Actively pursues effective and efficient operations of his/her respective areas, while ensuring the adequacy, adherence to and effectiveness of day-to-day business controls to meet obligations with respect to operational risk, regulatory compliance risk and conduct risk, including but not limited to responsibilities under the Operational Risk Management Framework, Regulatory Compliance Risk Management Framework, and the Scotiabank’s Code of Conduct.
  • Attend to business travel requests and coordinate the response and approval in conjunction with the APAC Country Compliance teams.
  • Liaise with internal and external training providers as and when necessary to provide periodic training to Scotiabank in Asia Pacific.
  • Assume joint responsibility with the Director, Head of Central Compliance, APAC, for:
    • tracking of the completion of compliance training.
    • liaison with internal and external training providers.
    • liaison with Global Compliance on compliance risk assessments, reporting, etc.
    • handling incoming correspondence and filing.
  • Maintenance of APAC Compliance intranet sites; develop/enhance these as platforms for APAC Compliance to share documents online, including administration, creation of internal file-sharing sites/folders for the APAC Compliance team and its programs of work. In addition, act as the regional administrator for APAC Compliance documents on Global Compliance Document Repository site(s).
  • Respond to queries from APAC employees, as well as Compliance counterparties in other jurisdictions on APAC Central Compliance policies, processes, and controls.
  • Ensure prompt escalation of compliance issues.
  • Maintain compliance knowledge through appropriate training and monitoring of emerging regulatory, legal and Group initiatives and requirements.
  • Assist the Director, Head of Central Compliance, APAC, and VP, Head of Compliance, Asia Pacific as well as business senior management with ad hoc tasks and projects.
  • Be an active part of the APAC Central Compliance team and undertake tasks as assigned from time to time in agreement with the Director, Head of Central Compliance, APAC
Education / Experience
  • Minimum 5 to 7 years of experience in regulatory coordination/management and governance reporting.
  • Excellent verbal and written English skills are required
  • Good understanding of the various business within GBM and GT
  • Good working knowledge of the Monetary Authority of Singapore regulations, guidance and principles.
  • Knowledge of any other Asia Pacific jurisdictional regulations, rules and principles would be an added advantage
  • Working understanding of the Singapore financial services sector, including banking, sales and trading, mergers and acquisitions and capital markets
  • Strong written and verbal business communication skills
  • Superior knowledge of Microsoft applications (including Word, Excel and Power Point)and familiarity with the internet and related applications as tools for conducting compliance related research
