Job summary

A legal services firm in Gqeberha is looking for an Attorney to manage estates. Key responsibilities include estate planning consultations, drafting wills, filing necessary forms, and liaising with clients and institutions. The ideal candidate has experience in estate management, holds a valid driver’s license, and possesses a bookkeeping diploma. This role requires excellent organizational skills and attention to compliance with legal protocols.

Qualifications

  • Admitted as an Attorney with at least three years experience in Estates is advantageous.
  • Basic Bookkeeping Diploma is advantageous.
  • Must hold a valid Code 08 Driver's License.
  • Own transport is necessary.

Responsibilities

  • Draft wills and maintain a database.
  • Consult clients about estate planning needs.
  • Interview family members of deceased clients.
  • Complete forms for lodging with the Master of the High Court.
  • Travel to Masters Court as required.
  • Write letters regarding assets and liabilities.
  • Obtain valuations of assets.
  • Handle sale or transfer of shares and fixed property.
  • Manage income tax reporting and compliance for the estate.
  • Pay all claims filed against the estate.
  • Liaise with family members on estate progress.
  • Open banking accounts in the name of the estate.
  • Maintain filing and records.
  • Keep a diary and timesheet.
  • Draw up liquidation and distribution accounts.
  • Attend to curatorship estates and accounts.
  • Handle Will Trusts and related documentation.
  • Keep records of work in progress for directors.
  • Maintain monthly cashbook of estates.
  • Complete various forms for financial institutions.
  • Draft trust documents for registrations.
  • Assist clients with trust changes.
  • Follow up with Master, banks, and financial institutions.
  • Advertise estates timely.
  • Comply with the firm’s policies and procedures.

Key Duties and Responsibilities
  • Drafting of wills and maintaining a database
  • Consultation with various clients about their estate planning needs
  • Interviewing family members of a deceased client
  • Completion of required forms on death of a client, to lodge with Master of the High Court
  • Travelling to Masters Court
  • Writing letters about assets and liabilities
  • Obtaining valuations of assets
  • Attending to the sale or transfer of shares and fixed property
  • Taking care of income tax to the date of death by reporting the estate at SARS, applying for a Deceased Estate Compliance Certificate, and liaising with the Tax Department
  • Payment of all claims filed
  • Liaising with family members about the progress of the estate
  • Opening a banking account in the name of the estate
  • All filing
  • Maintaining a diary and timesheet
  • Drawing up liquidation and distribution accounts
  • Attending to all matters relating to curatorship estates
  • Drawing up curatorship accounts
  • Attending to Will Trusts
  • Maintaining a record of work in progress and submitting weekly to directors
  • Maintaining a monthly cashbook of all estates
  • Completion of all forms (Sasfin, Investec, conveyancing, insurance policy forms, etc.)
  • Drafting trust documents to open a trust, and attending to the registration of a trust
  • Assisting clients with changes that need to be made on a trust
  • Constantly following up with the Master, banks, and various financial institutions and reporting to the Ombudsman if they do not respond
  • Advertising the estates at the correct times
  • Compliance with the firms System of Quality Management (SOQM), policies, and procedures
  • Compliance with the firms Employee Code of Conduct, which consists of the firms HR policies, SAICA, IRBA, and IESBA Codes of Conduct
