Descrizione del lavoro

Please, only apply if you have a valid Attorney at Law license and are authorized to practise law by the Regulation Authority in Italy.

About AirAdvisor: we are dedicated to ensuring air travelers receive the compensation they are entitled to for flight disruptions. We launched a new baggage-claims service for lost, delayed, and/or destroyed luggage in June 2025. We operate in the EU, UK, and other international markets, providing services in 21 languages (with 9 more forthcoming). We have processed over 500,000 claims for clients from 221 countries and hold a 4.7-star rating from 25,850+ reviews. AirAdvisor aims to reach 1 million claims by the end of 2026.

We are seeking a highly skilled Litigation Lawyer specializing in consumer flight claims (typically via small claims procedure) to lead in-court collections and, potentially, to establish a boutique legal firm in Italy. Pre-court collections are managed by a team of paralegals. You will be responsible for filing batches of court cases to recover compensation and/or reimbursement of Out-of-Pocket Expenses (OPE) incurred by passengers and/or recover ticket refunds. AirAdvisor currently handles three types of airline claims: EU261 compensation for flight delays, cancellations, and denied boarding; and three types of baggage claims under the Montreal Convention: lost, delayed, and/or destroyed luggage.

If a court decision is unfair, we may consider escalation to influence the law where feasible. There may be PR opportunities related to court victories and essential legal issues to raise public awareness. This is an excellent opportunity for high performers who can self-perform, have strong litigation experience, and are passionate about advocating consumer rights in the airline industry.

The candidate must be free from conflicts of interest and able to litigate against different airlines.

Requirements :

  • A valid Attorney at Law license in Italy and professional liability insurance.
  • A law degree from an accredited institution.
  • Experience with small claims, consumer rights, or aviation law is a plus, but not required.
  • Knowledge of relevant consumer protection laws and aviation regulations is a plus, but not required.
  • Proven track record of in-court collection success.
  • Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies.
  • Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.
  • Experience in automating and standardizing claims management processes to scale quickly.

Responsibilities :

  • Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction. If feasible, assist in establishing a law firm in Italy, including corporate structuring and registering relevant foreign counsel where applicable.
  • Pre-court collections and out-of-court settlements.
  • Prepare and file batches of approximately 200+ new claims monthly in Italian courts against various airlines to recover:
  • a) Compensation under EU Regulation 261/2004 and/or Turkish SHY Regulation for flight delays, cancellations, and denied boarding.
  • b) Reimbursement of out-of-pocket expenses under EU261/2004 and/or the Montreal Convention.
  • c) Ticket refunds owed to passengers under applicable legal frameworks.
  • d) Handle baggage-related claims under the Montreal Convention and/or Warsaw Convention, including delayed, damaged, or lost luggage.
  • Respond comprehensively and assertively to airline defenses, including substantive and procedural/jurisdictional challenges.
  • Lead enforcement of court judgments, including initiating enforcement proceedings and coordinating with authorities when necessary.
  • Engage in court-led settlement negotiations and represent AirAdvisor’s interests in favorable settlements where applicable.
  • Maintain complete and accurate legal case files, ensuring compliance with Italian legal ethics, data protection regulations, and professional standards. Conduct thorough legal research and analysis to identify best practices in airline and consumer rights litigation.
  • Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents to provide updated legal advice and representation.
  • Where appropriate, pursue appeals and advocate for legislative changes if strategically feasible.
  • Support the optimization and automation of claims management workflows using legal technology solutions, including AI-based tools, to improve efficiency and scalability.
  • Identify and propose new civil-claims opportunities viable under Italian law with low-value, high-volume potential (examples may include cross-jurisdictional analysis across EU/UK markets to adapt precedents for Italy).
  • Represent AirAdvisor in local media and coordinate with the PR Manager to leverage public relations opportunities around landmark rulings or significant legal developments.
  • Review and vet content as needed to build local trust and authority.
  • Advocate for passenger and consumer rights within the airline and travel industry.

Soft skills :
