Overview

The College of Immigration and Citizenship Consultants is the authority mandated by the Government of Canada to regulate the practice of Regulated Canadian Immigration Consultants (RCICs) and Regulated International Student Immigration Advisors (RISIA). The College sets and enforces licensing, education and ethical standards in the public interest. The Tribunal Committee is the adjudicative arm responsible for addressing concerns about licensee conduct and competence, balancing public protection with a fair and objective process.

The College is seeking to strengthen its Tribunal Committee to support the mandate of addressing conduct and capacity concerns and to provide hearings that are fair and efficient. The main objective is to resolve or adjudicate cases related to professional conduct and capacity issues. The adjudicative panel consists of a Vice-Chair and two Tribunal members who will render decisions.

Responsibilities
  • Preside over hearings and draft the decision and reasons after a panel has made a decision.
  • Conduct case management, settlement conferences and/or motion hearings, including videoconferencing.
  • Prepare and write decisions; most hearings are conducted in writing with submissions from parties.
  • Manage time commitments, including up to 3 days per month (approximately 5% in-person and 95% videoconference/teleconference).
  • Lead, mentor and collaborate with other Tribunal Members; assist Chair in building a collegial and expert panel.
  • Adhere to relevant procedures and criteria, apply legislation, the Code of Professional Conduct and Tribunal Rules of Procedure.
  • Promote adjudicative excellence through training, meetings and staying current on laws and best practices.
  • Ensure impartiality, integrity, and compliance with ethical obligations and confidentiality.
  • Provide adjudicative support to other Members and participate in reforms and continuous improvement initiatives.
  • Draft decisions with clear, complete and concise reasons; participate in the draft decision review process.
  • Provide strategic advice and assist in case management and workflow improvements.
Qualifications
  • Significant adjudicative experience; experience in oral hearings preferred and bilingualism required.
  • Advanced judgment, tact and ability to manage contentious and sensitive issues; strong analytical and organizational skills.
  • Experience in various dispute resolution forms (e.g., mediation) and in working with part-time tribunal members and tribunal staff.
  • In-depth knowledge of administrative law, professional regulation, and relevant College legislation (By-laws, Regulations, Code of Professional Conduct, Rules of Procedure).
  • Understanding of the work of immigration professionals and the public governance context; ability to work within the College's governance structure.
  • Excellent oral and written communication in English and French; computer skills including Microsoft Word.
  • Not be the subject of any conduct or capacity case referred to the Tribunal within the last 5 years; no disciplinary record with other regulatory bodies in the last 5 years.
Term and Remuneration
  • Term: Appointed by the Board of Directors for terms between 1 and 3 years, with opportunities for reappointment.
  • Remuneration: Per diem with compensation options based on half-hour, hourly, half-day or full-day; travel expenses and partial travel time covered per College policy; remuneration is comparable to other adjudicative tribunals in Canada.
