Job summary

A leading financial services firm in Durban is seeking a qualified legal professional to manage legal risks and provide advisory support for various loan agreements. The ideal candidate should possess a Bachelor of Law, be an admitted attorney and conveyancer, and have 5 to 8 years of relevant experience in corporate law. This role requires expertise in contract law and a strong background in commercial law, with knowledge of relevant legislation such as the Companies Act and Insolvency Act.

Qualifications

  • 5 to 8 years of relevant legal experience.
  • Experience in banking and corporate legislation is advantageous.
  • Working knowledge of the Companies Act, Insolvency Act, and Trust Property Control Act.

  • Manage legal risks while ensuring commerciality.
  • Provide legal advisory support for various loan agreements.

Description

Manage the legal risk of the bank whilst maintaining commerciality, which includes, inter alia, instructions of bonds, authorising payments, restructuring loans, vetting documents, and drafting guarantees.

Perusing entity documents to establish locus standi of the entity entering into the contractual obligation.

Key Responsibilities

Provide a legal advisory and support service with regards to : Instalment sale agreements, Secured and unsecured loans, home loans, building bonds, commercial properties, mortgage commercial developments and restructures

Instructing bonds to panel attorneys and managing the file until registration

Advising consultants on legal aspects of deal structure

Drafting nonstandard clauses for agreements

Vetting of documents and authorising payments

Review credit minutes and ensure that all condition precedents on minutes are fulfilled and security is perfected

Advise on aspects of Companies Act and Insolvency Act

Qualifications, Experience and Skills

Bachelor of Law, Admitted Attorney and Conveyancer

5 to 8 years of relevant experience

Good general commercial law background and experience

Working knowledge of FICA and NCA

Experience in contract law and drafting of contracts

Banking experience and corporate legislation an advantage

Working knowledge of Trust Property Control Act, Companies Act, Insolvency Act and Close Corporations Act
