Role Scope:

The Project Commercial Lead is responsible for overseeing all commercial aspects of construction projects, ensuring contractual compliance, cost control, claims management, and strategic stakeholder engagement. This role demands deep expertise in FIDIC contracts and UAE construction law, strong leadership, and a proactive approach to risk and dispute management.

Key Responsibilities

  • Interpret and implement FIDIC contract conditions and UAE-specific clauses Advise project teams on contractual rights, obligations, and risks
  • Ensure timely compliance with notice requirements (e.g., Sub-Clause 20.1 / 20.2)
  • Coordinate with the Engineer on determinations, variations, and claims
  • Review and manage contractual correspondence for consistency and defensibility
  • Establish and maintain project budgets and value management systems
  • Monitor cash flow, earned value, and cost-to-complete metrics
  • Evaluate variations and prepare substantiated cost proposals
  • Control subcontractor costs in alignment with main contract terms
  • Deliver monthly CVRs and financial summaries to stakeholders
  • Identify potential claims (delays, disruptions, legislative changes)
  • Submit timely and substantiated claims per FIDIC timelines
  • Coordinate multidisciplinary claim preparation
  • Negotiate and defend claims with Engineer/Employer
  • Maintain a comprehensive claims register
  • Manage variation processes: identification, notification, valuation, agreement
  • Assess Engineer’s instructions for entitlement to time/cost adjustments
  • Maintain contemporaneous records to support claims
  • Support Engineer/Employer determinations with detailed substantiation

  • Advise on mitigation and exploitation strategies
  • Maintain and review commercial risk register with leadership
  • Liaise with Engineer, Employer, and consultants on commercial matters
  • Coordinate with internal teams to capture commercial impacts
  • Support executive reporting and strategic decisions
  • Lead and mentor commercial and quantity surveying teams
  • Ensure consistent application of procurement and reporting procedures
  • Train staff in FIDIC, cost management, and claims documentation
  • Promote proactive dispute avoidance and procedural compliance
  • Prepare and manage DAB submissions
  • Assist legal counsel in arbitration or formal dispute resolution

Skills & Experience Requirements

  • Bachelor’s degree in Quantity Surveying, Civil Engineering, Construction Management, or a related field Professional certification (e.g., MRICS, PMP, or equivalent) is highly desirable
  • Strong knowledge of FIDIC contracts and UAE construction law
  • Minimum 10 years of total experience in commercial management within the construction industry At least 5 years in a senior commercial or contract administration role on large-scale infrastructure or building projects in the UAE or GCC region
  • Proven experience managing claims, variations, and final accounts under FIDIC-based contracts
  • Demonstrated leadership of commercial teams, including mentoring and performance management
