JOB TITLE : Tribunal Committee Tribunal Member, RCIC
Department : Tribunal Committee
Reports to : Chair of the Tribunal Committee

The College is looking to build and strengthen its Tribunal Committee in support of its mandate to address concerns about licensee conduct and competence, balancing public protection with a fair and objective process. The main objective of the Tribunal Committee is to resolve or adjudicate cases regarding professional conduct and capacity issues. Adjudicative panels include a Vice-Chair and two other Tribunal members who will make the decision. The following appointment is currently open for application: Tribunal Committee Member (2 positions).

The successful candidate must have 5-7 years experience as an RCIC with a varied scope of practice and understanding of immigration processes and a good conduct and compliance record with the College.

Responsibilities
  • As a Tribunal Committee Member, sit on a three-person panel to adjudicate complaints that have been investigated and referred for a disciplinary hearing, along with adjudicating other conduct or capacity cases.
  • Participate in proceedings as a side member of the three-member panels.
  • Review and analyze evidence and submissions, and make determinations on reasonable and probable grounds while applying the College Code of Professional Conduct, Regulations and By-laws.
  • Maintain impartiality and open-mindedness in committee meetings and decisions.
  • Carry out dispute resolution and decision-making processes in a timely manner to meet internal time targets.
  • Understand and apply relevant procedures and criteria to a case in accordance with legislation, the Code of Professional Conduct, and Tribunal Committee Rules of Procedure.
  • Promote adjudicative excellence through training, participation in meetings, and staying updated on current laws, policies and best practices.
  • Act with integrity and confidentiality in accordance with College policies, including per diem and expenses.
  • Respect and practice equity, diversity and inclusion; uphold human rights accommodation obligations.
  • Promote access to justice and fairness in all proceedings.
  • Recognize and address potential bias or conflicts of interest; work collegially with other Members and the Tribunal Office.
Qualifications
  • 5-7 years experience as an RCIC with a varied scope of practice and understanding of immigration processes.
  • Good conduct and compliance record with the College.
  • Strong communication and interpersonal skills to work on three-member panels and achieve consensus.
  • Commitment to professional development as an adjudicator.
  • Not the subject of any conduct or capacity case referred to the Tribunal Committee; no disciplinary record with the College or other regulatory bodies.
  • Excellent English and French oral and written communication (non-imperative language requirement).
  • Computer skills, including Microsoft Word.
  • Meet basic eligibility requirements for Board/Committee members per By-laws 2021-2.
Time Commitment and Remuneration
  • Time Commitment: up to 2 days per month, including approximately 5% in-person and 95% videoconference or teleconference proceedings, plus preparation and writing time. Most hearings are conducted in writing.
  • Remuneration: per diem; compensation may be based on half-hour, hourly, half-day or full-day increments. Travel expenses and part of travel time are covered under College expense policy. Remuneration is comparable to other adjudicative tribunals in Canada.
  • Term: appointments by the Board of Directors for 1 to 3 years, with opportunities for reappointment.

Introduction Le Comit du Tribunal est lorgane dcisionnel du College qui remplit les fonctions des Comits de discipline, de laptitude et dautres comits. Les membres du Comit du Tribunal sont nommés par le conseil d’administration du College et relèvent du président du Comit du Tribunal. Un jury composé d’au maximum trois personnes est chargé de mener les audiences et procédures qui mènent à des décisions exécutoires touchant les titulaires de permis et les candidats.

Principales fonctions des membres : Examiner et statuer sur les dossiers, analyser les éléments de preuve, maintenir l’impartialité, respecter les délais, promouvoir l’excellence de l’arbitrage, et agir avec intégrité. Compétences et Qualifications : expérience RCIC 5-7 ans, bon dossier de conduite, capacités de communication, esprit de collaboration sur un panel à trois, formation et perfectionnement professionnel, et respect des obligations éthiques et légales.
