Job Title: Commercial Lead
Key Responsibilities:
- Lead or assist with the negotiation and administration of contracts with clients, ensuring alignment with organizational goals and regulatory requirements.
- Structure and manage various partnering agreements, fostering long-term strategic alliances.
- Optimize contractual arrangements to support commercial models, aligning with business objectives and project delivery frameworks.
- Assist with risk review processes, including identification, mitigation, and management of contractual and legal risks.
- Provide commercial support to Engineering, Service Lines, and Business Development teams to secure new business opportunities in the APAC region.
- Offer recommendations on drafting, negotiating, and concluding contracts, sub-contracts, partnerships, and agreements with clients, especially in Malaysia and the APAC region.
- Lead commercial and legal input for activities such as tenders and client negotiations.
- Support contract drafting, ensuring appropriate risk balance and legal protections.
- Finalize qualifications and deviations to contract terms with clients.
- Support due diligence on potential partners and clients.
- Coordinate with legal, tax, and compliance functions regarding structuring opportunities and key contract terms.
- Manage interface with Group Legal and external law firms for agreement finalization and audits.
- Develop and monitor Commercial KPIs for the business unit.
- Ensure commercial terms comply with risk management processes and are timely incorporated into proposals.
- Coach and guide contract team members.
- Resolve issues with clients to achieve favorable outcomes.
- Handle non-routine issues affecting procurement.
- Update processes as needed in line with business and project requirements.
- Report non-compliance issues related to procurement processes.
Essential Qualifications and Skills:
- Degree in Law preferred.
- Ability to prepare contractual correspondence and position papers, with strong analytical and drafting skills.
- Organized, energetic, with excellent communication skills.
- Experience working with multiple stakeholders and managing priorities effectively.
- Previous experience as Contract Advisor or Contract Administrator in engineering, resources, or construction industries.
