Job Description

The Construction Counsel will be responsible for carrying out a range of contentious and non-contentious duties, mainly overseeing and managing cases related to latent defect claims, as well as providing vital services in connection with the formation and review of complex construction contracts and other legal matters. Main duties include:

Contentious:
  • Providing support and monitoring the day-to-day running of case files;
  • Reviewing and contributing to submissions for adjudication and arbitration proceedings, and overseeing proceedings in the Technology & Construction Court;
  • Handling complex/high-value commercial dispute resolution, including pre-litigation matters.
Non-Contentious:
  • Advising on all aspects of construction contracts, including payments, extensions of time, loss and expenses, defects, procurement, and insurance issues;
  • Amending and advising on contracts such as building contracts, development agreements, agreements for lease, and appointments for consultants and contractors, including all supplementary documentation like security documents, warranties, novations, and assignments;
  • Drafting and reviewing complex construction contracts, including those from the NEC and JCT suites, along with other industry-standard templates;
  • Providing legal advice to the Special Projects Team on procurement matters related to complex construction procurement exercises.

The Successful Applicant

The ideal candidate will be a qualified lawyer in England & Wales (or an equivalent Common Law jurisdiction) with a minimum of three years PQE as a contentious construction lawyer. They should have a thorough understanding of the Housing Grants, Construction & Regeneration Act 1996, the Scheme for Construction Contracts (England & Wales) Regulations 1998, the Civil Procedure Rules, and disrepair issues related to property maintenance.
