Reporting to the Supervisor, Prosecutions the Level 2 Prosecutor is responsible for court assignments including early resolution court, parking court, and minor traffic court. Additionally, the Level 2 Prosecutor will assist Level 1 Prosecutors by providing administrative and research support.

Duties and Responsibilities

Prosecute Part I and II charges in Provincial Offences Court
• Conduct early resolution meetings
• Conduct Part II (parking) trials
• Conduct Part I minor traffic trials
• Conduct Part I municipal trials
• Conduct case-specific legal research
• Draft Charter application responding materials including facta, supporting affidavits, and Documentary Briefs under supervision
• Liaise with internal and external enforcement officers
• Review of mvcs to determine which witnesses are required for the LAs to send Summons
• Prepare witnesses for trial
• Manage civilian witnesses for Part I trials including charges arising from motor vehicle collisions
• Respond to requests for additional disclosure

Support Level 1 Prosecutors
• Assist with research and preparation for complex cases
• Assist in preparing Appellant or Respondent materials including facta and book of authorities
• Assist with disclosure for Part III files
• Assist with Body Worn Camera and dash cam evidence review and disclosure for Part III cases
• Over-see the compilation of Guilty Plea/Withdrawal dockets
• Review enforcement requests for motions to change trial dates
• Review of Prosecution Briefs to determine witnesses required to be subpoenaed for trial

Skills and Qualifications

• Licensed and in good standing with the Law Society of Ontario (paralegal or lawyer)
• University degree or post-secondary education in a legal program (Paralegal / Court & Tribunal Agent)
• Minimum 1 to 3 years of experience prosecuting in the POA Court
• Advanced knowledge of the Provincial Offences Act (POA)
• Working knowledge of the legislation, regulations, and City by-laws that give rise to the charges issued and prosecuted in the City of Mississauga. This includes the Highway Traffic Act, Compulsory Automobile Insurance Act, Planning Act, Building Code Act, Building Code, Fire Protection and Prevention Act, Fire Code, Municipal Act, Trespass to Property Act, Liquor Licence and Control Act, Quarantine Act, Cannabis Control Act, Contraventions Act, and Traffic on the Land Side of Airport Regulations.
• Understands the requirements and obligations set out in the Memorandum of Understanding
• Understands the importance of maintaining the public’s confidence in the justice system
• Understands and demonstrates to the public through their actions that the prosecution process is independent and free from political and enforcement intervention
• Excellent written & oral communication skills
• Strong organizational and administration skills and ability to prioritize tasks
• Ability to work independently and on own initiative
• Attention to detail and accuracy
• Sound problem-solving, decision-making, and conflict resolution skills

Hourly Rate/Salary:$ 78,602.00 - $ 104,806.00
Hours of Work:8:30am - 4:30pm
