Overview

As a Banking and Securities Litigation Law Clerk, you will provide support to both the Banking Litigation and Securities Litigation teams with escalations and other matters.

What will you do?
  • Responding and managing through to completion various banking and securities related litigation/dispute inquiries received at RBC Law Group from the front-line staff and back-end offices. Inquiries will relate to debt collection/recovery, court procedures/documents, releases/settlement documentation, negligence, fraud, privacy, unjust enrichment and client complaints.
  • Reviewing complex third-party demands (court orders, CRA legislated demands or deemed trust claims, forfeiture/seized property orders, etc.) to assess the legal basis, the bank’s obligation(s), the feasibility of compliance and assisting with implementation. Includes advising and responding to claims that RBC did not properly comply with the third-party demand.
  • Reviewing motion, application and petition materials to assess risk to the bank, advising opposing party of bank’s position, negotiating terms of waivers or orders and retaining external counsel, if required. Aiding with Small Claims and Superior Court litigation as needed.
  • Providing guidance and support on receipt of legal notices and documents (subpoenas, summons to witness, notice of general security agreements, notice of arrears from creditors, notice of liens, etc.).
  • Advising on and drafting correspondence, including cease and desist letters, communication to opposing counsel and settlement agreements or other legal documents.
  • Tracking, monitoring and reporting on banking and securities litigation inquiries, develop best practices for managing same and initiate process improvements/efficiencies.
  • Assisting the banking and securities litigation teams with discovery/eDiscovery related tasks, if required.
What do you need to succeed?

Must-have

  • 2+ years of litigation law clerk experience.
  • Law Clerk diploma or certificate from a Canadian post-secondary institution
  • Experience with Court Rules, Procedure and Documents
  • Excellent problem-solving and client service skills
  • Ability to ensure accuracy, attention to detail and meet deadlines in a timely manner
  • Interacts well with others, is a flexible team member and collaborative

Nice-to-have

  • BA or BSc degree or equivalent
  • Paralegal designation and/or license
  • Knowledge of banking law (in the context of disputes arising from the banker-client relationship) and securities
  • Knowledge of RBC and/or other financial institutions or payments.
