Job Summary
Leader of LATAM South Legal - Kidney Care will be an integral and important member of Kidney Care's legal team helping drive the Company's mission, protecting the Company, and serving as a trusted advisor and leader within the legal department and the Company.
The LATAM South Legal lead will provide both strategic and tactical support in the region and will serve as a strategic legal partner to the senior leadership of Kidney Care.
This role is ultimately responsible for building and leading legal strategy for Baxter's Kidney Care segment and functions, as well as executing the Company's legal strategies, spearheading contracting, and pre-dispute efforts in the region.
Reports to the Head of the Americas, Legal - Kidney Care.
Essential Duties and Responsibilities
- Lead a team of lawyers in Brazil and Colombia that advises the Company on corporate, commercial, M&A, regulatory, antitrust, public procurement, compliance, IP and other legal issues relating to south LATAM jurisdictions (Brazil, Colombia, Ecuador and Chile) as well as to our indirect markets in South America.
- Advise the Company on legal / contractual rights / responsibilities for high risk / profile contracts.
- Proactively identify legal risks for highest risk / profile issues and develop / approve an action plan.
- Keep abreast of all legal, legislative, and regulatory developments, apprise senior management in a timely manner and assure full compliance with new laws, regulations, or policy matters.
- Train Company on legal topics and cascade training and information through the organization, acting as strategic partner for the commercial teams to limit risk; identify opportunities and suggest / implement solutions for better practices regarding structure, systems, and delivery of services.
- Establish strong relationships with internal and external constituents; responsible for relationships with key outside legal firms.
- Manage / mentor employees and develop guidelines for direct reports managing others; advise and support resolution in cross-functional issue escalation.
Qualifications
- Experience in a wide spectrum of legal matters, including corporate, commercial, M&A, regulatory, antitrust, public procurement, compliance, IP and international law.
- Experience advising internal clients relating to civil, corporate, M&A, and public and regulatory law, including drafting, negotiating, and overseeing the management of contracts.
- Ability to identify legal risks and advise clients accordingly.Ability to function in a high‑paced legal environment and to proactively develop strategies to ensure efficient and effective counsel.
- Substantive management experience, including managing relationships with a diverse group of senior executives and the demonstrated ability to work across organization lines on a global basis.
- Preferably prior experience counseling clients in healthcare (medical products, biologics, and / or pharmaceutical) and / or medical services environments.
- Fluent in Spanish, Portuguese, and English.
Education and / or Experience
- Successful track record of at least 15 years of experience, ideally gained in a combination of working in a major law firm and in-house corporate legal department.
- At least two years working in or with medical device and pharmaceutical companies on healthcare-related activities.
- Licensed in good standing to practice law in Brazil.
