Zusammenfassung

Lumentum seeks a senior International Trade Counsel to advise on global trade matters across products, technology, transactions, supply chain, and operations. You will guide on EAR, ITAR, sanctions, customs, and licensing, shaping risk-based solutions for a multinational tech environment.

The role requires a JD, active bar membership, 15+ years of international trade experience, and a proven ability to influence across functions and jurisdictions.

Qualifikationen

  • J.D. or equivalent required with strong background in international trade law.
  • Active bar membership in at least one U.S. jurisdiction preferred.
  • 15+ years of experience advising on international trade, export controls, sanctions, customs, or related discipline.
  • Experience in a multinational technology or manufacturing company strongly preferred.
  • Expertise in EAR, ITAR, OFAC sanctions, and U.S. customs laws.

Jobbeschreibung

  • Advise business leaders and stakeholders on global trade matters affecting products, technology, transactions, supply chain, and operations
  • Provide legal guidance on U.S. and non-U.S. export controls, economic sanctions, customs and import requirements, antiboycott rules, and international trade laws
  • Assess geopolitical developments, regulatory actions, tariffs, trade remedies, and government policy initiatives; communicate risks and recommended actions to senior leadership
  • Support commercial, supply-chain, product, and operational decisions by identifying trade requirements and developing risk-based solutions
  • Partner with the Legal Department on agreements, transactions, investigations, disclosures, and trade compliance matters
  • Advise on export jurisdiction and classification for hardware, software, technology, technical data, and services under the EAR, ITAR, and non-U.S. regimes
  • Analyze licensing requirements, license exceptions, exemptions, de-minimis and foreign direct product rules, reexports, retransfers, deemed exports, and controlled technology access
  • Support export license applications, commodity classifications, advisory opinions, government filings, and license-condition monitoring
  • Advise on restricted-party, end-use, end-user, destination, diversion-risk, and sanctions screening; evaluate red flags and conduct due diligence
  • Guide Technology Control Plans and controls governing access to controlled technology, technical data, and facilities
  • Support investigations, voluntary and directed disclosures, enforcement matters, and government inquiries or audits
  • Advise on customs classification, valuation, country of origin, marking, admissibility, foreign-trade zones, and import compliance
  • Assess tariffs, Section 301 and Section 232 measures, antidumping and countervailing duties, forced-labor restrictions, and trade remedies
  • Partner with Logistics, Supply Chain, Finance, and external customs brokers on entry, clearance, post-entry, and duty issues
  • Support customs audits, protests, prior disclosures, ruling requests, and interactions with customs authorities
  • Improve global trade compliance policies, procedures, controls, training, and governance
  • Establish risk-based processes for classification, licensing, screening, technology controls, import compliance, recordkeeping, and escalation
  • Conduct or oversee compliance assessments, internal reviews, audits, risk analyses, and remediation tracking
  • Develop and deliver targeted training and communications
  • Promote consistent global standards while accounting for local legal requirements and operational realities
  • Champion trade compliance technology, automation, data analytics, and artificial intelligence
  • Represent Lumentum in engagements with government agencies, regulators, industry associations, outside counsel, and external stakeholders
  • Monitor legislative, regulatory, and enforcement developments and coordinate impact assessments and business communications
  • Build relationships across the company and advocate for ethical, compliant, and commercially practical global trade practices
  • Contribute to Legal Department strategic priorities and a culture of sound judgment, accountability, and continuous improvement
Requirements
  • Juris Doctor (J.D.) or equivalent law degree required
  • Active bar membership in at least one U.S. jurisdiction preferred
  • 15+ years of experience advising on international trade, export controls, economic sanctions, customs, or a related legal and compliance discipline
  • Experience in a multinational technology or manufacturing company strongly preferred
  • Demonstrated expertise in the EAR, ITAR, OFAC sanctions, and U.S. customs laws
  • Experience with related non-U.S. trade regimes preferred
  • Practical experience with export classifications, licensing, deemed exports, technology-control programs, restricted-party screening, customs matters, trade remedies, investigations, and government inquiries
  • Strong understanding of how trade requirements intersect with product development, engineering, supply chain, manufacturing, logistics, sales, procurement, and commercial transactions
  • Excellent legal judgment and ability to assess complex, incomplete, or fast-changing facts and provide clear, timely, actionable recommendations
  • Exceptional written, verbal, and executive communication skills
  • Strong relationship-building and influencing skills; ability to collaborate across functions, cultures, and jurisdictions
  • Self-directed, pragmatic, and solutions-oriented; ability to manage multiple priorities in a fast-paced global environment
  • Fluency in English required
  • Additional language skills and experience working across Asia, Europe, or other international regions are a plus
