Job summary

Wilson Elser is seeking a Senior Cyber Incident Response Attorney for a fully remote role based in the United States. The attorney will lead incident response efforts for cybersecurity and data privacy incidents, oversee breach responses, and coordinate with clients, carriers, and senior management.

The role requires 8+ years of legal experience, 5+ years in data privacy and security, and strong knowledge of HIPAA, GLBA, FERPA, CCPA, and GDPR.

Qualifications

• JD from an accredited law school is required.
• Must be admitted to the bar in good standing.
• 8+ years of legal experience.
• 5+ years of experience in data privacy and security, focusing on data breaches and incident response.
• Strong knowledge of HIPAA, GLBA, FERPA, CCPA, GDPR, etc.
• IT or technical background is a plus.
• Some litigation experience is a plus.
• Excellent research, writing, and communication skills (Lexis and Westlaw).
• Ability to work in a fast-paced environment.
• Team player.

Responsibilities

• Lead incident response for cybersecurity and data privacy incidents.
• Oversee breach response work by associates and client/carrier interactions.
• Interact with senior management and technical personnel at client sites.
• Analyze state, federal, and international privacy laws.
• Draft breach notices to individuals and regulators.
• Respond to regulatory investigations and privacy lawsuits.
• Draft privacy and security policies and procedures under HIPAA, GLBA, CCPA, GDPR, etc.
• Triage data breaches/incident response.
• Advise clients on handling cybersecurity incidents from start to finish.
• Oversee forensics investigations and third-party vendors.
