Qualifications

• Florida Bar admission and ability to practice in both State and Federal Courts in Florida.

Responsibilities

• Litigate personal injury cases from inception through trial/hearing, drafting pleadings and motions.
• Conduct and defend depositions of plaintiffs, witnesses, medical providers, and experts.
• Provide updates to P&I clubs on case status and strategy.
• Manage litigation files: decide depositions, motions, records, and overall strategy.
• Conduct mediations to resolve cases and reduce liability.
• Perform legal research to support the company's position.
• Handle related tasks such as subpoenas and writs as needed.

JOB SUMMARY:

• The litigation attorney will defend the company and litigate various types of cases in both state and federal court, as well as arbitrations and small claims matters.
• This includes conducted various aspects of litigation functions.
• The purpose of this position is to reduce the amount of cases referred to outside counsel in order to effectuate cost savings to the company..

POSITION RESPONSIBILITIES:

• Litigate mostly personal injury cases and perform all necessary functions to defend a legal case from inception through trial/final hearing, including but not limited to the following: Draft pleadings and motions to be filed with the court which will defend the company's position on various legal issues (these tasks may occur at anytime during the course of litigation).
• Conduct and defend depositions of plaintiffs, witnesses, medical providers, and experts (these tasks may occur at anytime during the course of litigation).
• Provide periodic updates to our P&I clubs regarding the status of cases and provide legal advice on how to proceed with the litigation and strategy (this requires an initial summary of the case and completion of case management questionnaires).
• Routinely make decisions concerning the management of litigation files such as who needs to be deposed, what motions need to be filed, what records need to be obtained, and ultimate strategy on what is best for the company based on the development of the case.
• Conduct mediations in order to resolve cases and reduce the company's liability (this task is typically completed after certain depositions and discovery have been completed, but may be done earlier depending on the Court's order).
• Perform legal research in order to support the company's legal position.
• Perform other job related functions as assigned, including but not limited to, responding to subpoenas, responding to writ of garnishments, drafting correspondence to third parties, litigation of matters as needed, and attend to other tasks as needed from a legal perspective..

DEGREE TYPE:

• Juris Doctorate.

FIELD(S) OF STUDY:

• Legal.

EXPERIENCE:

• Minimum 2-5 years experience in major law firm or legal department handling all aspects of litigation.
• Must have a background and working knowledge of General U.S.
• Maritime Law, including the Jones Act.
• Experience in litigating passenger and crewmember claims..

COMPETENCIES & SKILLS:

• Intermediate-level knowledge of Microsoft Office, Lexus Nexus, Westlaw, and Microsoft Outlook.
• Exceptional oral and written communication skills.
• Must possess interpersonal skills to work effectively with senior management and all team members.
• Ability to handle all aspects of litigation, including hearings, depositions, discovery, mediations and trials.
• Ability to handle full caseload and work successfully in a fast paced team environment.
• Excellent analytical research and writing skills.
• Excellent organizational skills in order to comply with time-sensitive court deadlines.
• Ability to work effectively with all team members in the organization..

CERTIFICATIONS & LICENSES:

• Law degree from an accredited program with admission to Florida Bar with ability to practice in both State and Federal Courts in Florida..
