To assist with Litigated Road Traffic Accident claims and, where required, to effectively manage a portfolio of litigated small claims track files under the supervision and guidance of a Supervisor.
The role involves handling both quantum and liability small claims and some lower value fast track cases efficiently and proactively, utilising effective telephone negotiation techniques to obtain appropriate settlements.
This position is ideal for someone looking to take their first steps into litigated file handling and develop the skills needed to manage a full litigated caseload. Induction training will be provided, along with ongoing support and mentoring from a senior handler or supervisor.
Key Accountabilities:
- Manage a caseload of Small Claims Track cases, ensuring workload planning and organisation to meet Court and OIC portal deadlines.
- Achieve performance targets and uphold quality standards.
- Analyse evidence to develop initial case strategies on liability and quantum.
- Conduct effective telephone negotiations with clients, defendants, third-party insurers, and solicitors to pursue efficient and appropriate case settlements and cost apportionment.
- Proof witnesses, assess their evidence, and draft statements.
- Draft Court documents and ensure all deadlines are met.
- Instruct, brief, and liaise with Counsel.
- Guide defendants through the litigation process and set appropriate expectations.
- Maintain accurate case management, billing, and management information records to support decision-making.
- Delegate tasks appropriately within the team.
- Handle correspondence and calls within service level agreements.
- Update reports upon receipt of new evidence.
- Adhere to client guidelines and provide up-to-date progress information.
Experience, Skills, and Qualifications:
- Established legal experience through education or practice.
- Experience in file handling within a law firm or insurance environment.
- Good understanding of highway code and basic road traffic principles.
- Strong planning and prioritisation skills.
- Efficiency in a process-driven setting.
- Proactive attitude towards development opportunities.
- Excellent listening, verbal, and written communication skills.
- Attention to detail and ability to follow instructions.
