The position involves leading cybersecurity incident response, regulatory interactions, and drafting notices, with significant responsibility for clients, carriers, and junior staff. The ideal candidate has a JD, bar admission, 8+ years of legal experience, and 5+ years in

Qualifications

• JD from an accredited law school.
• Bar admission in good standing.
• 8+ years of legal experience.
• 5+ years of data privacy and security experience, focusing on data breach and incident response.
• Strong knowledge of HIPAA, GLBA, FERPA, CCPA, GDPR, etc.
• IT background is a plus.
• Some litigation experience is a plus.
• Excellent research, writing, and communication skills (Lexis and Westlaw).
• Ability to work in a fast-paced environment.
• Team player.

Responsibilities

• Lead incident response for cybersecurity and data privacy incidents.
• Oversee breach response work by associates and client communications.
• Interact with senior management and technical personnel at client companies.
• Analyze state, federal, and international privacy laws.
• Draft breach notices to individuals and regulators.
• Respond to regulatory investigations arising from data breaches.
• Defend privacy lawsuits.
• Draft privacy and security policies under HIPAA, GLBA, CCPA, GDPR, etc.
• Triage data breaches and incident response.
• Advise clients on handling cybersecurity incidents from start to finish.
• Oversee forensics investigations and third-party vendors for e-Discovery and data mining.
• Advise on legal notification obligations under state/federal laws.
• Draft breach notification letters and crisis communications.
• Respond to inquiries by regulators.
• Interface with clients and prepare reports for insurers and clients.
• Prepare legal budgets and supervise junior team members.
