Qualifications

  • Active Florida Bar license in good standing.
  • Minimum 2 years of litigation experience.
  • Probate experience required.
  • Excellent drafting, analytical, and client communication skills.

  • Collaborative team player with a professional yet approachable “non-stuffy” style.

Responsibilities

  • Represent clients in probate litigation, including will contests, trust disputes, fiduciary breach claims, and guardianship proceedings.
  • Conduct case evaluations, develop litigation strategies, and advise clients on risks, costs, and probable outcomes.
  • Draft pleadings, motions, discovery requests, and other court documents.
  • Prepare for and participate in mediations, hearings and potentially trial.
  • Collaborate with the Estate Planning and Probate teams on integrated matters involving both planning and litigation.
  • Maintain strong client relationships through clear communication and regular case updates.
  • Manage a caseload efficiently while meeting deadlines and maintaining high-quality work product.
  • Stay current with Florida probate, trust, and guardianship law and procedural rules.
  • Participate in business development and client referral activities as appropriate.
  • Uphold the highest standards of legal ethics, professionalism, and confidentiality.

About the Role

As a Probate Litigation Attorney, you will be responsible for representing clients in litigation involving will contests, trust disputes, fiduciary breaches, and related probate proceedings. The attorney provides strategic legal counsel, litigates cases, and works collaboratively with the firm’s estate planning and probate team.

Salary and Benefits
  • Salary is $130,000 - $150,000 per year
  • Bonuses based on engaging clients for our services as well as the outcomes you deliver in litigation. Both of these can be substantial.
