Job summary

Canon Medical Systems USA, Inc. seeks an experienced Counsel to advise CMSU on commercial contracts, regulatory matters, and privacy issues within the medical device sector.

You will draft and negotiate complex agreements, review marketing materials for compliance, oversee sponsorships and grants, manage litigation with outside counsel, and train staff on healthcare compliance and company policies.

Qualifications

• Law degree required and admission to the State Bar.
• Minimum three years' practice, preferably with a medical device/equipment company.

Responsibilities

• Draft, review and negotiate complex commercial contracts, including but not limited to customer, business development, research, consulting, vendor and supplier agreements.
• Review and advise on materials to be submitted in response to RFPs (request for proposal).
• Review marketing collateral for compliance with Truth in Advertising principles (ensure compliance with standards, applicable regulatory requirements, and company standards).
• Advise on requests for approval of commercial sponsorships and educational grants.
• Manage litigation and pre-litigation matters primarily handled by outside counsel.
• Draft and review company policies and procedures concerning healthcare compliance (e.g., Anti-Kickback statute, False Claims Act and FDA regulatory issues) as well as other company policies.
• Provide legal advice to CMSU regarding various areas of law, including healthcare compliance, employment law, and privacy.
• Create and conduct training regarding various legal and compliance matters.
• Conduct legal research on issues impacting the company as well as its subsidiaries.
