We are seeking an experienced Contract Manager to lead and manage the contractual and commercial aspects of construction projects from tender and procurement through post-contract administration and final account closeout.
The successful candidate will be responsible for protecting the Company's contractual and commercial interests through effective contract administration, commercial management, claims and variation management, Extension of Time (EOT), cost control, negotiation, risk management and dispute resolution, while ensuring compliance with contractual, statutory, Company, Delegation of Authority (DOA) and Integrated Management Systems (IMS) requirements.
Key Responsibilities
- Lead and manage tender, measurement, pricing, commercial evaluation and subcontract procurement activities.
- Review tender documents, BQ, specifications, drawings and contract conditions to identify commercial, contractual and execution risks.
- Lead the evaluation and negotiation of subcontractor and supplier quotations, LOAs and subcontract agreements.
- Manage post-contract administration, including progress claims, Variation Orders (Vos), Extension of Time (EOT), contractual notices, claims and final accounts.
- Monitor contractual obligations, notice periods, submission deadlines and key milestones to minimise the Company's exposure to delay, loss, liquidated damages and contractual penalties.
- Monitor project cost, commitments, cash flow, cost-to-complete, commercial risks and profitability against approved targets.
- Lead contractual and commercial negotiations with clients, consultants, subcontractors and suppliers.
- Manage contractual claims, disputes and settlement negotiations, escalating significant matters to Senior Management where required.
- Monitor subcontractor contractual performance and recommend appropriate corrective or contractual actions for non-performance, delays or breaches.
- Ensure compliance with the Company's Delegation of Authority (DOA), procurement procedures, contractual requirements and applicable statutory requirements.
- Support and promote compliance with the Company's Integrated Management System (IMS), including ISO 9001, ISO 14001, ISO 45001 and ISO 37001 (ABMS).
- Promote integrity, transparency and ethical commercial practices, including compliance with anti-bribery and anti-corruption requirements.
- Lead, supervise, coach and develop Assistant Contract Managers, Senior Contract Executives, Contract Executives and assigned personnel.
- Prepare and monitor commercial KPIs, forecasts, cost reports and management reports, providing recommendations to improve project profitability.
- Represent the Company in commercial meetings, contractual negotiations, claims discussions and final account settlements.
- Undertake other contract, commercial and project-related responsibilities as assigned by Management.
Job Requirements
- Minimum six (6) years of relevant experience in quantity surveying, commercial management or contract administration within the construction industry, including at least three (3) years in a senior, supervisory or managerial contract/commercial role.
- Strong knowledge and extensive practical experience in tender management, BQ preparation, measurement, subcontract procurement, progress claims, variation claims, Extension of Time (EOT), contractual claims, final accounts and contract administration.
- Strong working knowledge of Malaysian standard forms of contract, including PAM, PWD/JKR, CIDB and FIDIC, together with relevant statutory, contractual and commercial requirements.
- Strong understanding of contractual entitlement, claims management, variation procedures, delay and EOT matters, contractual notices, dispute management, negotiation and commercial risk assessment.
- Strong practical understanding of Integrated Management Systems (IMS), including ISO 9001, ISO 14001, ISO 45001 and ISO 37001 (ABMS), including Section 17A of the MACC Act 2009.
- Proficient in Microsoft Office (Word, Excel) and quantity measurement software such as Cubicost, Glodon, Buildspace or equivalent.
- Strong commercial, analytical, numerical and problem-solving skills, with sound understanding of project profitability, cost control, forecasting, cash flow and financial performance.
- Strong negotiation, communication, interpersonal and stakeholder management skills with Strong negotiation, communication, interpersonal and stakeholder management skills, with the ability to effectively manage contractual and commercial matters with clients, consultants, subcontractors, suppliers and Management.
- Demonstrated leadership and people management skills, with the ability to supervise, coach, develop and manage Contract and Commercial personnel while managing multiple projects and priorities.
- High level of integrity, confidentiality and ethical judgement with the ability to promote transparency, accountability and compliance with the Company's Anti-Bribery Management System.
- Good command of Bahasa Malaysia and English, with flexibility to work beyond normal working hours when required.
