Brooks Kushman P.C. is seeking an experienced Trademark Attorney with 5+ years of experience managing domestic and international trademark portfolios for leading brands.

This role offers the opportunity to work closely with in-house counsel and business stakeholders on all aspects of trademark protection, including clearance and counseling, prosecution strategy, portfolio management, enforcement, and brand protection. The ideal candidate will have substantial experience conducting trademark clearance investigations, handling pre-litigation disputes, managing online enforcement and takedown programs, working with brand protection platforms, and coordinating global enforcement efforts.

We are looking for a strategic, business-minded attorney who thrives in a collaborative environment and enjoys helping clients build, protect, and enforce valuable brand assets worldwide. Experience managing large international portfolios and coordinating with foreign counsel is strongly preferred.

Key Responsibilities

• Manage domestic and international trademark portfolios for a diverse range of clients, from emerging companies to globally recognized brands.
• Conduct trademark clearance searches and provide risk assessments and strategic counseling related to brand selection, adoption, and expansion.
• Prepare, file, and prosecute trademark applications before the USPTO.
• Advise clients on portfolio strategy, maintenance, renewals, and international filing programs.
• Handle enforcement matters, including cease-and-desist letters, pre-litigation disputes, online marketplace enforcement, social media takedowns, domain name disputes, and anti-counterfeiting initiatives.
• Manage global trademark matters and coordinate with foreign counsel on prosecution, enforcement, opposition, cancellation, and portfolio management activities.
• Provide practical, business-focused advice regarding trademark, copyright, advertising, and related brand protection issues.
• Collaborate with colleagues across the firm's prosecution, litigation, and transactional practices to provide comprehensive intellectual property counseling.

Qualifications

• J.D. from an accredited law school and admission to practice in at least one U.S. jurisdiction.
• Minimum 8 years of trademark experience, including significant experience managing U.S. and international trademark portfolios.
• Extensive experience with trademark clearance, prosecution, enforcement, and counseling.
• Strong understanding of trademark law, USPTO practice, and international trademark systems, including the Madrid Protocol.
• Experience coordinating with foreign counsel and managing global trademark strategies.
• Excellent written, analytical, client counseling, and communication skills.
• Ability to independently manage client relationships and complex trademark matters.

Preferred Experience

• Experience advising clients in technology, automotive, consumer products, entertainment, retail, or other brand-intensive industries.
• Experience with online brand protection programs, marketplace enforcement, and anti-counterfeiting initiatives.
• Familiarity with trademark oppositions, cancellations, and related proceedings before the TTAB.
• Business-oriented approach to intellectual property strategy and risk management.
