Active Consulting Services LLC seeks an experienced attorney to join its Employee Benefits and ERISA practice in Roseland, NJ. The role involves advising employers, plan sponsors, and fiduciaries on retirement plans, benefits programs, and related tax matters, with exposure to estate planning and tax concerns.

Qualifications

• J.D. from an accredited law school.
• Bar admission in good standing in New Jersey.
• 8+ years of experience in ERISA, employee benefits, or retirement plans.

Responsibilities

• Advise on ERISA compliance, fiduciary duties, and IRC provisions.
• Design and amend qualified retirement plans (401(k), ESOPs, etc).
• Prepare Form 5500 filings and coordinate with actuaries and auditors.
• Represent clients in IRS/DOL audits and correction programs.
• Advise on health and welfare plan compliance (ACA, COBRA, HIPAA).
• Support M&A work on benefit matters and due diligence.
• Assist with executive compensation arrangements (Section 409A).
• Assist with estate planning and trust administration (Forms 706, 709, 1041).
• Provide tax guidance and audits support as needed.
• Serve as primary client contact and drive business development.
