Profile

A law firm seeks an experienced Senior Associate Attorney to join its Employee Benefits team in Los Angeles, CA. The ideal candidate will have at least seven years of experience in employee benefits law, specifically with ERISA and qualified retirement plans, including defined benefit plans and 401(k) plans. The role involves advising clients on benefit structures, tax qualification, fiduciary duties, plan investments, and more. The successful candidate will draft and review retirement plan documents, handle plan corrections, and guide clients through compliance and regulatory matters.

Duties:

  1. Provide expert legal advice on qualified retirement plans, including traditional defined benefit plans, 401(k) plans, and other employee benefit structures.
  2. Draft and review retirement plan documents, ensuring compliance with evolving tax qualification requirements.
  3. Offer guidance on fiduciary responsibilities, plan governance, funding, investments, and administration.
  4. Advise on benefit plans during mergers, acquisitions, and downsizing.
  5. Handle plan corrections and regulatory compliance issues.
  6. Review and negotiate service provider agreements for retirement plans.
  7. Assist clients with participant communications and benefit claims.
  8. Conduct legal research on employee benefits laws and best practices.
  9. Prepare clear communications to explain complex legal concepts.
  10. Build strong relationships with clients, providing strategic legal support.

Requirements:

  • Minimum of seven years of experience with ERISA and employee benefits law, specifically in qualified retirement plans.
  • Experience with multiemployer plans, cash balance plans, and 403(b) plans is a plus.
  • Extensive experience drafting, reviewing, and amending retirement plan documents.
  • Ability to advise on tax qualification, fiduciary duties, and plan investments.
  • Expertise in negotiating service provider agreements.
  • Ability to communicate complex legal issues clearly.
  • Strong client relationship management and business development skills.

Education:

  • Juris Doctor (JD) from an accredited law school.

Certifications:

  • Admission to practice law in Washington, DC, or Illinois, Massachusetts, New Jersey, Ohio, Pennsylvania, or Tennessee.
