The Arizona State Board of Nursing is seeking a NURSING INVESTIGATOR SENIOR to join the Compliance department in Phoenix. This role will oversee investigations related to substance use, mental health disorders, and practice concerns among licensed nurses, ensuring compliance with Board orders and the Nurse Practice Act.

The position involves reviewing reports, collecting evidence, and presenting findings to support board actions.

Qualifications

Job Summary:

This role is assigned as a Senior Investigator to the Compliance department, who oversees nurses in non-public and public disciplines due to substance use, mental health disorders and practice concerns.

Reviews participant’s reporting and results across multiple computer applications to ensure compliance and accountability for all the terms and conditions of legal agreements or Board orders.

Communicates non-compliance to participants and/or attorneys, assists as able to restore compliance or prepares cases for administrative review/action.

Investigates any new conduct or complaints regarding alleged violations of the Nurse Practice Act.

Investigates complex or sensitive allegations of legal or regulatory violations.

Job Duties:

• Reviews participant’s reporting and results across multiple computer applications to ensure compliance and accountability for all the terms and conditions of legal agreements or Board orders. Communicates non-compliance to participants and/or attorneys, assists as able to restore compliance or prepares cases for administrative review/action. Investigates complaints violations regarding and alleged risks to violations public of safety. the Nurse Investigates Practice Act complex and or apply sensitive knowledge allegations throughout of legal the or regulatory investigatory violations; process to interviews determine violations and risks to public safety. Collects evidence; examines and analyzes records and files
• Extracts and analyzes information from statutes, legal documents, evaluations, healthcare and employment related records; interviewing and eliciting information in an investigation, and writing detailed investigatory reports with findings of fact, citation of suspected violation/s of the Nurse Practice Act, and disciplinary recommendation for Board action
• Applies and interprets Federal, State and agency laws, rules, regulations, and policies regarding nursing practice and complex investigations. Applies and interprets civil, criminal, or regulatory laws of complex nature
• Prepares and issues subpoenas to obtain or inspect pertinent information (police reports, medical records, personnel records, etc) and have information sent to the Board office. Prepares Interim Orders requesting licensee to consider voluntary participating based on prior actions taken by the Board, and thereafter, presenting to the board for final determination, Gathers, compiles, and preserves detailed evidence. Review and record case materials into agency's internal case management system
• Prepares cases for administrative review/action, prepares consent agreements for use in administrative proceedings. Presents cases at Board Meetings and testifies in administrative hearings as official witness. Work with applicable staff to refer criminal offenses to external agencies, when applicable
• Other duties as assigned as related to the position

Knowledge, Skills & Abilities (KSAs):

Knowledge:

• Methods and techniques/principles for applying state and federal statutes, administrative codes, and agency policies related to nursing practice and nursing license regulation
• Requires knowledge in the area of nursing practice, terminology, and meaning of the Nurse Practice Act
• Methods, techniques and principles for writing investigative reports

Skills:

• Identify regulatory violations, and prepare detailed investigative reports with findings and recommendations in accordance with state laws and administrative rules
• Interviewing and eliciting information in an investigation; time management, public speaking, and professional writing
• Skills in extracting and using information from statutes, legal documents, evaluation forms, and related records

Ability:

• Presenting cases in a Board meeting and testify in administrative law hearings as the expert witness
• Prioritize, plan, analyze, coordinate and manage a caseload
• Produce timely and accurate reports and documentation
• Ability to work well with others
• Maintain objectivity

Selective Preference(s):

• Experience with investigations, substance abuse, social work, and or legal testifying preferred

• Requires possession of and ability to retain a current, valid state-issued driver’s license appropriate to the assignment
