Qualifications

• JD from an accredited law school.
• Active Texas Bar license or ability to obtain shortly after hire.
• 3–6 years of commercial litigation experience.
• Experience managing matters through all stages of litigation.
• Strong background drafting, reviewing, and negotiating commercial contracts.
• Knowledge of risk allocation provisions, indemnity clauses, and liability limitations.
• Experience supervising or coordinating with outside counsel.
• Construction/real estate development or related litigation experience preferred.

Responsibilities

• Manage a portfolio of litigation and dispute matters, including oversight of outside counsel and case strategy.

The company has experienced significant growth and is seeking an attorney to partner closely with business leaders on litigation management, commercial contracting, risk mitigation, and day-to-day legal matters impacting operations.

The Opportunity

Our client is seeking a Senior Counsel to join its legal team. This position will work directly with senior legal leadership and key business stakeholders across construction, purchasing, warranty, and sales functions.

This is an excellent opportunity for a litigation attorney looking to transition in-house or an experienced commercial attorney seeking a broad legal role that combines dispute resolution, contract negotiation, and strategic business counseling. The position offers meaningful exposure to operational decision-making and the opportunity to serve as a trusted legal advisor within a growing organization.

Key Responsibilities

• Manage a portfolio of litigation and dispute matters, including oversight of outside counsel, case strategy, discovery processes, and settlement evaluations.
• Investigate customer, vendor, and contractor disputes and provide recommendations regarding risk exposure and resolution strategies.
• Draft, review, negotiate, and interpret a wide range of commercial agreements, including vendor, supplier, trade partner, purchasing, professional services, and technology contracts.
• Advise business stakeholders on contract interpretation, risk allocation, indemnification obligations, insurance requirements, and limitation of liability provisions.
• Serve as a legal advisor to operational teams on day-to-day legal matters and business initiatives.
• Coordinate with outside counsel on active litigation, mediations, arbitrations, and other dispute-related proceedings.
• Develop and enhance contract templates, legal forms, policies, and procedures to improve efficiency and reduce organizational risk.
• Monitor legal and regulatory developments impacting construction, real estate, and operational activities.
• Support executive leadership on special projects, risk management initiatives, and strategic business matters.

Qualifications

• Juris Doctor (JD) from an accredited law school.
• Active Texas Bar license or ability to obtain licensure shortly after hire.
• 3-6 years of commercial litigation experience, either in private practice or in-house.
• Experience managing matters through all stages of litigation, including discovery, depositions, motions practice, mediation, arbitration, and trial preparation.
• Strong background drafting, reviewing, and negotiating commercial contracts.
• Knowledge of risk allocation provisions, indemnity clauses, insurance requirements, and limitation of liability language.
• Experience supervising or coordinating with outside counsel.
• Ability to provide practical, business-oriented legal advice to internal stakeholders.
• Construction, real estate development, contractor, subcontractor, or construction defect litigation experience is highly preferred.
• Strong communication, analytical, and problem-solving skills with the ability to manage multiple priorities in a fast-paced environment.
