Job summary

Discovery Capital Finance Corp. is seeking a diligent legal professional to support the Collections team in preparing, reviewing, and negotiating contracts, pleadings, briefs, and related documents for legal and collection matters.

You will attend court hearings and conferences, negotiate with borrowers/clients, and strive to achieve approved collection targets while ensuring compliance with applicable laws and company policies.

Qualifications

• Experience drafting, reviewing, and negotiating contracts and pleadings.
• Ability to attend court hearings and handle legal proceedings.
• Familiarity with BP 22, Small Claims, and Data Privacy Act considerations.

Responsibilities

• Prepare, review, and negotiate legal documents, including contracts, pleadings, briefs, legal requests, compromise agreements, and other documents related to legal and collection matters
• Attend court hearings, conferences, and other legal proceedings when necessary
• Handle negotiations with borrowers/clients and achieve the approved collection targets for accounts under the Legal Department
• Draft and file Affidavits and Complaints for BP 22 and Collection of Sum of Money cases, including Small Claims Court proceedings for qualified accounts endorsed by the Collections Team
• Review dishonored post-dated checks (PDCs), bank return slips, underlying contracts, and supporting documents to determine the legal viability of an account
• Draft, issue, and ensure proper and documented service of Notices of Dishonor and Demand Letters to support legal action and preserve applicable presumptions under BP 22 and collection cases
• Monitor the status and progress of all legal cases and regularly update the legal case calendar
• Maintain an updated master tracker of active collection cases, demand letters, court hearings, payment arrangements, and monthly account payments
• Coordinate and provide legal assistance to the Collections Department in handling delinquent accounts and collection-related concerns
• Ensure that collection activities and legal processes comply with applicable laws, regulations, and company policies, including SEC guidelines on unfair debt collection practices and the Data Privacy Act of 2012
