Overview

AirAdvisor is seeking a highly skilled Litigation Lawyer specializing in consumer flight claims (typically via small claims procedure) to lead in-court collections. The role involves filing batches of court cases to recover compensation and/or reimbursement of out-of-pocket expenses incurred by passengers and/or recover ticket refunds. The candidate will work in Italy with potential to set up a boutique Italian law firm and will coordinate with pre-court teams and AirAdvisor’s broader operations. This position requires an Attorney at Law licensed in Italy, or authorization to practice by the Regulation Authority in Italy, and the ability to litigate against different airlines without conflicts of interest.

Note: Please attach a simple Word file describing your experience in airline passenger claims under EU261 / 2004 or baggage claims under the Montreal Convention in English, as part of the application.

Responsibilities
  • Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction. If feasible, assist in establishing a law firm in Italy, including corporate structuring and related formalities.
  • Pre-court collections and out-of-court settlements.
  • Prepare and file batches of approximately 200+ new claims monthly in Italian courts against various airlines to recover: a) EU Regulation 261 / 2004 compensation, b) Reimbursement of out-of-pocket expenses under EU261 / 2004 or the Montreal Convention, c) Ticket refunds, d) Baggage-related claims under the Montreal or Warsaw Conventions.
  • Respond to airline defenses, including substantive, procedural, and jurisdictional challenges.
  • Lead the enforcement of court judgments and coordinate with enforcement authorities when necessary.
  • Engage in court-led settlement negotiations and represent AirAdvisor in favorable in-court settlements.
  • Maintain complete and accurate case files, ensuring compliance with Italian legal ethics, data protection regulations, and professional standards; conduct legal research and develop best practices for recurring issues in airline and consumer rights litigation.
  • Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and precedents to provide updated legal advice and representation.
  • Where applicable, pursue legal remedies including appeals and legislative changes if feasible.
  • Support optimization and automation of claims management workflows, including AI-based tools, to improve efficiency and scalability.
  • Identify and propose new civil claims opportunities viable under Italian law with low-value, high-volume potential, including cross-jurisdictional research across EU and UK markets for applicable precedents.
  • Represent AirAdvisor in local media as needed and coordinate with PR to raise public awareness of consumer rights.
  • Review and vet content as needed to build local trust and authority.
  • Advocate for passenger and consumer rights within the airline and travel industry.
Qualifications
  • A valid Attorney at Law license in Italy and professional liability insurance.
  • A law degree from an accredited institution.
  • Experience with small claims, consumer rights, or aviation law is a plus but not required.
  • Knowledge of consumer protection laws and aviation regulations is a plus but not required.
  • Proven track record of success in in-court collection.
  • Strong analytical and problem-solving skills for case assessment, legal research, and strategy development.
  • Ability to manage a caseload, meet deadlines, and track statute of limitations.
  • Experience in automating and standardizing claims management processes to scale quickly.
