Advising on general business law issues and managing the legal issues of all areas of the company, including: corporate matters, procurement, safety, security, insurance and sustainability issues, commercial, fleet, finance, operations, CS, Quality and CSR, etc.
To anticipate and manage the legal risks connected with or resulting from the business strategy and operations. Provide solid legal advice to the Company and make recommendations when necessary. To pro-actively create and maintain awareness of business employees for compliance with relevant laws and regulations.
Research and prepare legal reports of any matter.
To secure compliance of business operations with relevant laws and regulations.
Contract management.
Draft, Review, support during negotiation, and finalise supplier and customer contracts and agreements; ensuring the optimum legal and commercial position for the business included, but not limited to: Fleet; Sales; Airport, Railway concessions; Property Leases; Per-Rental suppliers; Other suppliers; In-country Franchise & Agency Partners.
Coordinate consumer requirements of any kind, court requirements, consumer associations, lawsuits.
Initiate and pursue legal proceedings as required by the Companies i.e., prepare writings and pleadings in coordination with the external law firm, in civil, criminal and administrative proceedings, both "for and against" the Company.
Corporate housekeeping regarding the Secretary BoD issues (annual accounts, minutes, certificates, etc)
Coordination with the Group in case it is necessary to implement local formalization.
Support in the preparation, implementation and/or modification of the Company's policies (Group's and Local).
Prepare, amend, review and/or recommend modifications to the Company's general terms and conditions within the framework of the regulations that govern it.
Work with Head of Legal and Group Secretary General in order to enhance:
Cross-country group functional innovations, local implementation of projects and programs.
Contribute to the enhancements of Group Legal Policies.
Provide support in Iberia cluster related Law.
Manage GDPR matters in coordination with Group DPO and per its request, according to the Group policy and guidelines: requests of rights exercises from clients, requests from the authority, contractual clauses, data processor agreements, and development of internal procedures to comply with GDPR requirements.
Local Implementation of Ethics and Compliance policies in coordination with Group Compliance Officer and per its request.
Cooperation with the other members of the legal department abroad (in-house, ECI or external legal firms).
Support Head of Legal in the preparation of the Legal Department's annual budget and projections of legal costs associated with litigation, compliance and special projects.
Manage payments concerning: legal fees (invoices) including legal firms, companies house, notaries etc, and judicial payments coming from legal procedures in course.
External Legal firms: coordination and report to the Legal Responsible about the quality, timing, and costs of legal services. Support to the negotiation of fees and billing, assessing the Legal Responsible in terms of knowledge of the tasks to be contracted and requested to the Legal firms.
