Qualifications

• Sound knowledge of STSMA Regulations.
• Exposure to CSOS matters is advantageous.
• Strong drafting and research abilities; good litigation understanding.

Responsibilities

• Assist with sectional-title, body corporate and trustee disputes.
• Draft pleadings, notices, correspondence and legal opinions.
• Engage in High Court and Magistrates' Court litigation where applicable.
• Conduct legal research on sectional-title legislation.
• Prepare and manage litigation files and client consultations.
• Provide general legal support throughout the litigation process.

CEDING CANDIDATE ATTORNEY – SECTIONAL TITLE LITIGATION

Location: Gauteng

Salary: R10,000 per month

A well-established legal practice is seeking a Ceding Candidate Attorney with existing practical experience in sectional-title law, litigation and dispute resolution to join their team.

MINIMUM REQUIREMENTS

• Currently serving articles and seeking to cede/transfer articles
• Meaningful practical experience in sectional-title law and litigation
• Exposure to sectional-title disputes and dispute resolution
• Sound working knowledge or practical exposure to the Sectional Titles Schemes Management Act (STSMA) and its Regulations
• Exposure to CSOS matters will be highly advantageous
• Strong legal drafting and research abilities
• Good understanding of litigation processes and procedures
• Excellent written and verbal communication skills
• Strong attention to detail and ability to work under pressure and meet deadlines

KEY RESPONSIBILITIES

The successful candidate will assist with and gain further practical exposure to:

• Sectional title, body corporate and trustee disputes
• Levy and arrears-related disputes
• Disputes between owners, trustees and/or managing agents
• Interpretation and enforcement of management and conduct rules
• Applications and other litigation proceedings arising from sectional-title disputes
• Drafting pleadings, notices, correspondence and legal opinions
• High Court and Magistrates' Court litigation where applicable
• Legal research relating to sectional-title legislation
• Preparation and management of legal and litigation files
• Assisting attorneys with client consultations and case preparation
• Legal drafting and preparation of court documentation
• Providing general legal support throughout the litigation process
