Job description

Overview
We are seeking a dynamic and experienced California Labor & Employment Trial/Arbitration Attorney to join our team. The ideal candidate will have a strong background in California employment law, with specific experience in handling PAGA (Private Attorneys General Act) cases and class action work. Additionally, the candidate should be able to handle cases with both wage/hour and FEHA (Fair Employment and Housing Act) components. This position is remote, with occasional in-person meetings as needed.

Duties

  • Represent clients in arbitration proceedings and disputes involving issues such as wage and hour claims, discrimination, and wrongful termination.
  • Prepare and present evidence, arguments, and legal strategies during arbitration hearings, which are typically less formal than court trials but still legally binding.
  • Handle a caseload of employment law matters, including wage/hour, FEHA, PAGA cases, and class action work.
  • Review and challenge arbitration agreements to ensure they are enforceable and comply with applicable laws. Challenge questionable agreements if they are found to be unfair or improperly drafted.
  • Negotiate settlements before or during arbitration to resolve disputes efficiently and avoid prolonged legal battles. This can involve mediating between parties to reach mutually agreeable terms.
  • Advise clients on the implications of arbitration laws and rules, which can vary by state. In California, arbitration attorneys may guide clients through specific state laws governing employment arbitration.
  • Conduct legal research, analysis, and case strategy development.
  • Draft legal documents, including complaints, motions, and settlement agreements.
  • Represent clients in mediations, arbitrations, and court proceedings.
  • Collaborate with other attorneys and legal staff on complex cases.
  • Stay updated on changes in employment law and legal trends.

Qualifications

  • Juris Doctor (JD) degree from an accredited law school.
  • Admitted to the California State Bar and in good standing.
  • 7+ years of experience practicing employment law in California, including class action work after PAGA cases - this is a critical requirement.
  • Class action certified.
  • Proven experience handling PAGA cases from start to finish.
  • Strong knowledge of Lodestar calculations and fee arrangements.
  • Ability to handle cases with both wage/hour and FEHA components.
  • Excellent legal research, writing, and analytical skills.
  • Ability to work with a diverse population.
  • Spanish-speaking ability is a plus but not required (sizeable Spanish-speaking clientele).
  • Flexibility to work remotely and attend in-person meetings as needed.
