Job description

Temporary Construction Defect Technical Claims Specialist

Frank Winston Crum Insurance (FWCI) issues workers’ compensation and general liability policies. The role adjusts complex construction defect claims and assists in establishing best cost‑effective strategies for handling this claim type.

Responsibilities
  1. Investigate, evaluate, and bring to timely resolution an inventory of the most complex construction defect claims, many of which are litigated and involve large projects in accordance with claim handling standards and applicable state regulations and laws.
  2. Understand construction defect coverage issues and handle complex coverage matters related to sub‑contractors, additional insured tenders by general contractors and developers, the Florida Chapter 558 process, and issuing reservation of rights letters and denial of coverage letters.
  3. Understand and interpret construction contracts and apply risk transfer when appropriate.
  4. Negotiate time on risk and the duty to defend and indemnify with liable insurers when appropriate.
  5. Manage litigation proactively and work well with defense counsel and insureds to reach optimal outcomes.
  6. Demonstrate strong knowledge and use of resolution techniques such as high‑low agreements, settlement proposals, and offers of judgement to obtain optimal outcomes.
  7. Evaluatively respond timely to time‑limit demands, consumer complaints, and Department of Insurance complaints, including civil remedy notices often filed in construction defect claims.
  8. Demonstrate strong knowledge of residential and commercial building construction and repair processes, and review and analyze the accuracy of damage reports prepared by contractors, engineers, and appraisers to assess property damage and construction‑defect damages.
  9. Show strong negotiation skills in alternative dispute resolution forums such as mediations and assist in finding early resolutions to obtain optimal outcomes when appropriate.
  10. Understand reserving requirements and philosophies and maintain appropriate reserves on all assigned claim files.
  11. Prepare reports detailing claim status, payments, and reserves.
  12. Engage in timely and effective communication with the appropriate parties and document the claim file throughout the claim adjustment process, including maintaining timely diaries on each claim.
  13. Effectively assist, train, and mentor less‑skilled team members in conjunction with management.
  14. Assist managers with identifying trends and opportunities for improvement in processes, procedures, and claim resolution to improve overall outcomes.
  15. Collaborate with other departments such as underwriting on projects or as needed or perform other duties as assigned.
Attributes We Seek
  • Knowledge of construction defect claims handling and applicable insurance policies, claims systems, regulations, procedures, and laws in 48 states.
  • Bachelor’s degree in a related field or equivalent experience; a Juris Doctorate is a plus.
  • Ten (10) years of construction defect claims adjusting experience with exposure to a minimum of $100,000.
  • Must hold proper adjuster licenses in Florida and other states with the ability to obtain additional licenses as needed.
Pay

The hourly pay range for this position is $40.00 – $45.00 per hour. These figures represent the annualized pay for both hourly and salaried types of positions and do not indicate employment is on a yearly basis nor remove the employee’s employment at‑will status.
