Job summary

Battery Park City Authority seeks a Special Counsel, Capital Projects in New York, NY. The role supports a $2B progressive design-build environmental resiliency project, reporting to the General Counsel and senior staff.

The candidate will oversee in-house and outside counsel, manage contract and procurement matters, and advise on risk across multiple project phases.

Qualifications

• J.D. required; admission to New York State Bar.
• At least 8 years of legal experience preferred with at least 3 years in construction law, ideally in public sector infrastructure.
• Must be admitted to practice law in New York.

Responsibilities

• Provide legal assistance for the North-West Resiliency Project, including access and easement agreements.
• Advise on delay claims, change orders, contract compliance, and responses to community members and stakeholders.
• Coordinate with outside construction counsel and report to the General Counsel, CEO, and senior project staff on schedule and contractual risks.
• Support project staff and senior management in problem solving for project challenges.
• Provide legal assistance on potential project litigation and environmental review matters.

Salary Range: $170,000.00 To $200,000.00 Annually

The Special Counsel, Capital Projects will join a collaborative seven-member legal department and report directly to the General Counsel. The Special Counsel will be the primary in-house construction counsel advising on a $2 billion progressive design-build environmental resiliency project, specifically, the BPCA’s North-West Resiliency Project.

• Provide legal assistance in connection with all aspects of the implementation of BPCA’s North-West Resiliency Project, including but not limited to negotiating all necessary access and easement agreements, advising on delay claims, change orders, contract compliance, and responses to community members and other stakeholders.
• Work in coordination with, and provide oversight to, outside construction counsel.
• Report to the General Counsel, CEO, and other senior project staff on all schedule and contractual risks associated with the Project.
• Work collaboratively with Project staff, other legal in-house and outside counsel, and senior management in problem solving with respect to Project challenges.
• Provide legal assistance with respect to any potential Project litigation and environmental review matters.
• Review draft procurement memoranda for capital construction projects.

Education and Experience:

• J.D required; admission to New York State Bar.
• At least 8 years of legal experience preferred with at least 3 years preferred construction law experience, ideally in connection with a public sector infrastructure project.
• Must be admitted to practice law in New York.
