Distinct | North America is seeking a Construction Defect Associate for a fully remote role based in California. You will handle complex multi-party construction defect files from SB800 notice through resolution, coordinating with site inspectors, experts, and opposing counsel.

The role requires California Bar admission and experience in construction defect or general liability defence, with a caseload that moves along and opportunities to transition across coverage or general liability areas

Qualifications

• Construction defect or general liability defence experience.
• Must be admitted to the California Bar.
• Ability to manage complex multi-party litigation.

Responsibilities

• Multi party construction defect files from SB800 notice through resolution.
• Site inspections and destructive testing where the answer is behind the stucco.
• Coordinating with roof, window and waterproofing experts, and reading the plans thoroughly.
• Cross complaints and indemnity tenders between the trades, and the allocation argument that follows.
• Tenders to the subcontractors’ carriers, and chasing the ones that dissolved years ago.
• Depositions and law and motion in California state court.
• Written discovery that arrives by the box, and a defect list that keeps changing.
• Mediations with fourteen defence counsel in the room and one plaintiff.
• A caseload that’s yours, on cases that do move along.
