Job Details

We are seeking an experienced, tenured Oil & Gas Title Opinion Attorney with a demonstrated track record of drafting, reviewing, and delivering complex title opinions involving oil and gas properties in North Dakota.

The ideal candidate will possess extensive knowledge of North Dakota oil and gas law, mineral ownership, real property law, and the legal principles governing mineral and leasehold title.

Key Responsibilities
  • Prepare, analyze, and deliver original drilling title opinions, supplemental and supplemental drilling opinions, division order title opinions, acquisition title opinions, and other oil and gas title opinions involving North Dakota lands.
  • Independently examine chains of title, abstracts, county recorder records, court records, probate proceedings, tax records, assignments, deeds, mortgages, easements, oil and gas leases, and other instruments affecting mineral, surface, and leasehold ownership.
  • Interpret and apply applicable North Dakota statutes, case law, recording requirements, real property principles, and oil and gas regulations to resolve ownership and title issues.
  • Analyze gaps in title, unreleased mortgages, conflicting conveyances, ambiguous legal descriptions, probate and succession issues, stale claims, adverse claims, and other defects. Recommend appropriate curative measures and draft requirements designed to protect the client's interests.
  • Determine ownership of fee mineral interests, royalty interests, overriding royalty interests, working interests, leasehold interests, and other interests affecting oil and gas development.
  • Evaluate mineral reservations and exceptions, severed mineral estates, dormant or abandoned mineral interests where applicable, fractionalized ownership, pooling and unitization instruments, and other issues arising under North Dakota law.
  • Review leases, assignments, memoranda, pooling agreements, unit orders, spacing orders, surface use agreements, and other instruments relevant to ownership and development.
  • Prioritize assignments, meet project deadlines, maintain consistent drafting standards, and manage multiple title projects with limited supervision.
  • Assist with acquisitions, divestitures, leasing, drilling programs, ownership verification, due diligence, and post-closing title matters as needed.
Required Qualifications
  • Juris Doctor (J.D.) degree from an accredited law school.
  • Active license and good standing with the North Dakota Bar, or eligibility to obtain admission as required for the position.
  • Substantial experience practicing oil and gas law, with a significant portion of that experience devoted to drafting and reviewing oil and gas title opinions.
  • Demonstrated, hands‑on experience preparing title opinions covering lands located in North Dakota.
  • Strong working knowledge of North Dakota real property law, mineral law, oil and gas law, and the recording system applicable to land and mineral interests.
  • Proven ability to independently analyze complex chains of title and prepare comprehensive, accurate, and defensible title opinions.
  • Extensive familiarity with oil and gas leases, deeds, mineral reservations, assignments, probate records, curative instruments, and other documents affecting mineral and leasehold ownership.
  • Exceptional legal research, analytical reasoning, drafting, and written communication skills.
  • Ability to manage competing priorities, exercise sound legal judgment, and deliver high‑quality work within established deadlines.
