Job summary

Red Lobster is seeking a Sr. Counsel, Real Estate to analyze, draft, negotiate, and advise on the Company’s real property portfolio. The role may involve occasional property acquisitions for new restaurants and interaction with Asset Management, Facilities, Operations, Tax and Property Accounting teams.

The attorney will handle communications with landlords, developers, and neighboring property owners and support the broader Legal team in strategic real estate matters.

Qualifications

• Minimum 7 years of law firm or in-house experience as a real estate attorney with emphasis on commercial real estate transactions, including leasing.
• Licensed to practice law and in good standing in Florida or eligible for in-house counsel admission in Florida.

Responsibilities

• Analyze and provide advice with respect to Company’s real estate portfolio (e.g., leases, surveys, easements, declarations, eminent domain, environmental matters); determine rights and obligations regarding maintenance, use, alterations, indemnities, CAM payments; respond to inquiries regarding insurance and indemnity requirements under documents.
• Apply innovative problem-solving skills in developing strategic solutions; provide legal advice and sound business judgment in a fast-paced environment.
• Negotiate and draft documents; draft and respond to legal notices (e.g., non-disturbance agreements, lease amendments, easements, default notices).
• Jointly maintain property management databases with other users
• Manage lease renewal process, including term expirations, renewal deadlines, and other material deadlines, with Asset Management
• Effectively manage outside counsel when retained
• Be an effective resource for the real estate team
• Assist with special projects and training of others

The Sr. Counsel, Real Estate analyzes, drafts, negotiates, and provides advice relating to all facets of the real property owned and leased by the Company. From time to time, the attorney will also work on the acquisition of properties for new restaurants. Counsel interfaces with members of the Asset Management, Facilities, Operations, Tax and Property Accounting teams, as well as other members of the Legal team. Counsel will communicate with landlords, developers and neighboring property owners, or their respective counsel.

RESPONSIBILITIES

• Analyze and provide advice with respect to Company’s real estate portfolio (e.g., leases, surveys, easements, declarations, eminent domain, environmental matters); includes determining rights and obligations regarding maintenance, use, alterations, indemnities, areas of responsibility and CAM payments; responding to inquiries regarding insurance and indemnity requirements under relevant documents
• Apply innovative problem-solving skills in developing strategic solutions; includes providing legal advice and applying sound business judgment in a fast-paced, high-demand environment
• Negotiate and draft documents; draft and respond to legal notices (e.g., non-disturbance agreements, lease amendments, easements, default notices).
• Jointly maintain property management databases with other users
• Manage lease renewal process, including accurately identifying term expirations, renewal notice deadlines, and other material deadlines, in collaboration with Asset Management
• Effectively manage outside counsel when retained
• Be an effective resource for the real estate team
• Assist with special projects and training of others

REQUIRED TECHNICAL SKILLS

• Minimum 7 years of law firm or in-house experience as a real estate attorney with emphasis on commercial real estate transactions, including leasing
• Licensed to practice law and in good standing under the Bar of of any state that enables admission to practice as in-house counsel in Florida

REQUIRED EDUCATION

• Juris Doctor Degree from an ABA accredited law school
