Job summary

The Department of Social Services seeks an Administrative Law Judge to conduct hearings for all programs, draft administrative rules, and assist during legislative sessions as part of the Legislative Task Force. The role is statewide and part of the Division of Legal Services within South Dakota.

Applicants must have a Juris Doctor, eligibility for the SD Bar, and strong research, writing, and analytical skills. Experience in administrative law or regulatory matters is preferred.

Qualifications

• Juris Doctor from an ABA-accredited law school.
• Admission to the South Dakota Bar, or eligibility with ability to obtain admission within six months of start date.
• Strong legal research, writing, and analytical skills.
• Excellent communication and interpersonal abilities.
• Experience in administrative law, regulatory matters, or litigation preferred.

Responsibilities

• Conduct administrative hearings for all programs within the Department of Social Services, ensuring admissibility of evidence, complete records, and fair hearings.
• Research, analyze, and interpret questions of law presented in hearings.
• Draft notices of hearing and other hearing documents.
• Prepare and issue high-quality hearing decisions in a timely manner.
• Collaborate with internal divisions to draft administrative rules governing the programs.
• Oversee the administrative rules promulgation process.
• Collaborate with the department’s legislative task force during the legislative session.
• Perform other duties as assigned.
