The Compliance Investigator partners with the Senior Compliance Investigator and Legal Counsel to facilitate the Company’s response to formal charges of employment discrimination, retaliation, and other employment violations received from state and federal agencies. This position is also responsible for staying informed on upcoming employment laws, researching all details of these laws, and updating reference materials accordingly. The position will also be expected to work with the appropriate teams to implement changes and communicate these changes to the field. The Investigator assists with wage and hour investigations or audits.
Essential Job Functions
- Investigate and respond to demand letters and formal charges of discrimination filed through the Equal Employment Opportunity Commission or applicable state agency. Engage with leadership and HR personnel to provide guidance and support on employment risks identified throughout the investigative process.
- Investigate and respond to administrative subpoenas or audits related to state-specific ordinances.
- Coordinate with counsel to prepare for and present the Company's position in mediation or conciliation related to formal charges of discrimination and/or retaliation.
- Represent the Company in depositions and employment litigation.
- Analyze large quantities of data to make appropriate employment recommendations.
- Identify potential areas of employment compliance vulnerability and propose and assist in implementing solutions to remediate risks.
- Research and implement current or upcoming federal, state, local, and international employment laws regarding drug testing, anti-harassment, non-discrimination, etc., including laws in Puerto Rico, Mexico, and Canada.
- Review articles, ordinances, FAQs, webinars, case law, and other resources.
- Consult with counsel and coordinate the implementation of new laws and ordinances with applicable teams.
- Prepare communication and documentation for field teams regarding new laws or ordinances.
- Maintain and update the state pages and policy manual on the Company’s intranet.
- Respond to timecard audit requests and conduct random audits of time records.
- Investigate and respond to wage and hour claims or audits, consulting with counsel as needed.
- Compile and maintain relevant documents related to wage and hour claims or formal charges.
- Maintain a Master Tracking List of Employment Laws and stay informed on relevant laws and policies.
- Perform other duties as assigned.
Skills, Education, and Experience
Required:
- High school diploma or equivalent (GED)
- Experience conducting sensitive and confidential investigations, including interview techniques
- Strong analytical, critical thinking, and discretion skills
- Organizational, planning, and time management skills
- Excellent written, verbal, and interpersonal communication skills
- Knowledge of and ability to interpret employment laws and regulations
- Ability to work under pressure and multitask
- Proficiency in MS Word, MS Excel, Outlook, and HRIS systems
- Self-motivated with limited supervision
- Ability to maintain composure in stressful situations and provide excellent customer service
Desired:
- Bachelor’s Degree in Human Resources or equivalent work experience (2 years)
- Previous investigative and team member relations experience
