Commercial Litigation Attorney

About the Role:

We are seeking an experienced Commercial Litigation Attorney with 7 to 10 years of sophisticated commercial litigation experience to join a growing litigation practice. This role is ideal for a highly skilled litigator who thrives on handling complex business disputes, developing litigation strategy, and managing high-value matters from inception through resolution. The successful candidate will possess exceptional legal writing abilities, significant experience managing motion practice and discovery, and the confidence to work independently while collaborating with a team of experienced litigators.

This position offers the opportunity to represent businesses, financial institutions, developers, and other commercial clients in complex litigation matters before state and federal courts.

Responsibilities:

• Manage complex commercial litigation matters through all phases of litigation, from case evaluation through trial or resolution.


• Develop case strategy and provide practical legal counsel to clients regarding litigation risks, exposure, and business objectives.


• Draft sophisticated pleadings, dispositive motions, legal memoranda, briefs, and appellate submissions.


• Independently manage all aspects of motion practice, including motions to dismiss, summary judgment motions, discovery motions, and other contested applications.


• Oversee and execute all phases of discovery, including document review, interrogatories, requests for production, depositions, expert discovery, and e-discovery.


• Conduct depositions of fact and expert witnesses and prepare clients and witnesses for testimony.


• Represent clients in court conferences, hearings, oral arguments, mediations, arbitrations, and trial proceedings.


• Negotiate settlements and alternative dispute resolutions while protecting client interests.


• Conduct comprehensive legal research and analyze complex legal issues to develop persuasive litigation strategies.


• Collaborate with partners, associates, paralegals, and litigation support professionals to efficiently manage complex cases.


• Maintain strong client relationships through responsive communication, strategic guidance, and exceptional client service.


• Mentor junior attorneys and assist with the development of litigation best practices.

Qualifications:

• Juris Doctor (J.D.) from an accredited law school.


• Active membership and good standing with the New York State Bar.


• 7 to 10 years of commercial litigation experience in a law firm environment.


• Extensive experience handling sophisticated commercial litigation matters.


• Demonstrated excellence in legal writing, drafting persuasive briefs, motions, and legal memoranda.


• Significant experience independently managing motion practice and complex discovery.


• Strong experience conducting depositions, court appearances, oral arguments, and settlement negotiations.


• Excellent legal research, analytical, and strategic problem-solving skills.


• Outstanding written and verbal communication skills.


• Proven ability to manage multiple complex litigation matters while meeting deadlines in a fast-paced practice.

Desired Qualifications:

• Experience representing businesses, financial institutions, developers, or commercial enterprises in complex litigation.


• Experience handling business disputes, breach of contract claims, partnership disputes, shareholder litigation, fiduciary litigation, or real estate litigation.


• Trial experience in state and federal courts.


• Experience managing electronically stored information (ESI) and complex e-discovery matters.


• Judicial clerkship experience is a plus.


• Demonstrated leadership abilities and experience mentoring junior attorneys.


• Business development experience and an interest in cultivating long‑term client relationships.
