Responsibilities

  • Drafts administrative rules and participates in rulemaking to ensure compliance with laws and agency objectives.
  • Responds to complaints, information requests, and legally related correspondence for the Department of Safety.
  • Provides legal counsel for Right to Know requests and ensures timely, lawful release of records.
  • Reviews and approves contracts and MOUs between the Department and third parties.
  • Oversees subordinate staff in the Legal Unit, including training and quality reviews.
  • Trains Department staff on responsibilities and authority.
  • Represents the Department before state agencies, drafts pleadings and motions, and presents evidence.
  • Assists legislative initiatives with drafting and testifies before committees as needed.
  • Provides legal research and opinions to management.

The State of New Hampshire, Department of Safety, Office of the Commissioner, Legal Unit has a full-time vacancy for an Attorney (Attorney III), SOC Title 23-1010 LAWYERS-3. This position has a 37.5-hour work week and is considered exempt.

Summary:

As a member of the Office of the Commissioner’s Legal Unit and under direct supervision of the Administrator, provides legal advice and consultation to the Department of Safety with regards to civil legal matters and liabilities.

YOUR EXPERIENCE COUNTS:

Each additional year of approved formal education may be substituted for one year of required work experience and/or each additional year of approved work experience may be substituted for one year of required formal education.

MINIMUM QUALIFICATIONS:

Education/Experience:

Equivalent combination of 11 years of education and experience after completion of high school. Education and experience must include the active practice of law demonstrating knowledge of civil procedure, administrative law, and the application of federal and state statutes and regulations.

License/Certification:

Valid driver’s license and/or access to transportation for statewide travel

Other Requirements:

  1. Selected candidate will undergo a fingerprint based criminal background check and motor vehicle record check in order to ensure suitability for exposure to confidential information.
  2. Must be an active member of the New Hampshire Bar Association and in Good Standing.

Responsibilities:
  • Drafts administrative rules and participates in the administrative rulemaking process to ensure compliance with state and federal laws, as well as fulfillment of the agency objectives.
  • Responds to complaints, requests for information, and correspondences of a legal nature relating to the Department of Safety.
  • Provides legal counsel and assistance in responding to Right to Know requests to insure the proper release of records in a timely manner and in compliance with law.
  • Reviews and approves contracts, memorandums of agreement, and memorandums of understanding between the Department and other agencies, organizations or third parties.
  • Provides oversight to subordinate staff assigned to the Legal Unit, including training and guidance, and reviewing work for accuracy.
  • Trains and provides education to Department staff regarding issues of responsibility and authority.
  • Appears before state administrative agencies, to include drafting pleadings, motions, discovery, preparing witnesses, and presenting evidence.
  • Provides technical and drafting assistance for legislative initiatives to amend existing statutes or enact new legislation to further the Department’s policies and objectives, and serves as the Department’s representative with regards to any testimony before Legislative Committees.
  • Provides legal advice and support to the management of the Department of Safety, including conducting legal research and preparing opinions.
