Qualifications

• 1–3 years civil litigation experience.
• Experience handling depositions and contested motions.

Responsibilities

• Independently manage active litigation caseload.
• Draft and file complaints, discovery, and substantive motions.
• Handle meet-and-confer disputes and discovery negotiations.
• Draft motions to compel and oppositions to summary judgment; prepare fee motions.
• Take and defend depositions; prepare clients for testimony.
• Negotiate buyback and cash-and-keep settlements; assess penalties and damages exposure.
• Draft motions in limine and trial briefs; serve as second-chair or lead on limited matters.

Role Overview

The Litigation Attorney independently manages a caseload of Lemon Law matters from filing through resolution. This attorney is expected to exercise sound litigation judgment, conduct depositions, argue routine motions, and negotiate settlements with minimal oversight.

This role marks the transition from training to full case ownership.

Position Classification & Reporting

• Classification: Full-Time; Exempt
• Reports To: Managing Partner or Senior Attorney

Key Responsibilities

Case Management

• Independently manage active litigation caseload.
• Draft and file complaints, discovery, and substantive motions.
• Handle meet-and-confer disputes and discovery negotiations.

Law & Motion

• Draft and argue motions to compel and oppositions to summary judgment.
• Prepare attorney fee motions in fee-shifting cases under the Magnuson-Moss Warranty Act and Song-Beverly Act.

Depositions

• Take and defend depositions of plaintiffs, service technicians, and PMKs.
• Prepare clients for testimony.

Settlement Negotiation

• Negotiate buyback and cash-and-keep settlements.
• Calculate statutory penalties and damages exposure.

Trial Preparation

• Draft motions in limine and trial briefs.
• Serve as second-chair at trial; may act as lead in limited matters.

Requirements

• 1-3 years civil litigation experience.
