Job summary

Incumbent is responsible for prosecuting criminal charges filed in Municipal Court and assisting assigned City departments with the enforcement of municipal ordinances.

REPORTING STRUCTURE:

Receives general guidance from the City Attorney or his/her designee.
Typical Class Essential Duties

1. Prosecutes criminal, civil, and administrative cases involving violations of City ordinances and Codes; and provides legal counsel in the defense of City actions, which includes: making opening statements; arguing preliminary motions; examining witnesses; introducing evidence; making arguments regarding the evidence and the law; and making sentencing recommendations.

2. Prepares cases for trial, which includes negotiating plea agreements; interviewing witnesses; reviewing physical evidence; and developing trial strategy.

3. Assesses legal risks and negotiates, drafts, and/or reviews legal documents such as ordinances, resolutions, contracts, bond issues, deeds, and leases that protect the City’s interest and resolve issues.

4. Evaluates and signs criminal arrest affidavits.

5. Reviews relevant case law, statutes, and ordinances and identifies possible impact on the City; keeps abreast of changes in the legal environment, and updates the Casper Police Department with changes to law that may have a significant impact on cases.

6. Coordinates departmental activities and priorities with other City departments and external agencies; attends meetings to receive and convey information

7. Represents the City of Casper by responding to the public, citizens, its employees, and others in a prompt, professional, and courteous manner while continuously maintaining a positive customer service demeanor.

8. Appeals cases as necessary to higher court.

9. May handle limited civil legal questions and projects.

10. Performs other duties of a similar nature or level.

•Legal principles and practices, including civil, criminal, constitutional, and administrative law and procedures.

•Ordinances, statutes, and court decisions relating to municipal government.

•Learn and efficiently use database systems like Incode, Spillman and similar Casper Municipal Court and Casper Police Department systems.
•Analyze problems, identify alternative solutions, project consequences of proposed actions and implement recommendations in support of goals.
•Establish and maintain effective working relationships with those contacted in the course of work.
•Follow the Rules of Professional Conduct for Attorneys.

Training, Experience & Certifications
EDUCATION and EXPERIENCE
•A Juris Doctorate from an accredited law school.
•Prefer three (3) years of professional legal experience, preferably in municipal law.

LICENSING and CERTIFICATIONS
•Membership in the Wyoming State Bar Association.

City of Casper employees in data creation and modification, security sensitive or safety and protective positions are subject to pre-employment drug testing. Some employees may be subject to random drug testing if their responsibilities include:
•Emergency response/rescue
•Handling or working with hazardous materials, including chemicals as well as solid and liquid waste
•Operating or maintaining water and wastewater systems
•Writing or modifying code, maintaining, or modifying City data systems including work on networks, servers, and communication systems
• CDL operations and driving
• Operating power-driven machinery or equipment
• Creating or modifying health, financial, security and/or risk documents or assessments
• Working with or directing minors

Positions in this class typically require: stooping, kneeling, crouching, reaching, standing, walking, pushing, pulling, lifting, grasping, talking, hearing, seeing and repetitive motions.

Sedentary Work: Exerting up to 10 pounds of force occasionally and/or a negligible amount of force frequently or constantly to lift, carry, push, pull or otherwise move objects, including the human body. Sedentary work involves sitting most of the time. Jobs are sedentary if walking and standing are required only occasionally and all other sedentary criteria are met.

Incumbents in this position work indoors in an office environment and/or Court Room and are subject to the common noises associated with an office environment including telephones, copiers, and printers. This position may have to travel to various locations such as courtrooms or meeting locations. Attorneys will experience a lot of stress when a case is being tried in court. The position requires frequent sitting, typing, and customer contact, both by telephone and in person.
