Job summary

First Balfour, Inc. seeks an experienced Claims Strategy and Dispute Lead for major infrastructure projects in the Philippines. You will develop and manage claims strategies, lead EOT analyses, and mentor the claims team to navigate complex contractual disputes.

Required are a Civil Engineering degree, 10–15 years in construction claims, and strong familiarity with FIDIC Pink Book provisions. This on-site role is based in Arca South, Taguig City with occasional travel as needed.

Qualifications

  • Bachelor’s degree in Civil Engineering, Construction Management, or related field.
  • 10–15 years of experience in construction claims and dispute management on major infrastructure or civil engineering projects.
  • Extensive experience administering and managing claims under FIDIC contracts, particularly the FIDIC Pink Book (MDB Harmonised Edition).
  • Proven expertise in EOT, delay, disruption, and quantum claims; delay analysis methodologies (TIA, Windows Analysis, As-Planned vs As-Built).
  • Leadership of claims teams and management of complex commercial disputes.
  • Professional memberships such as MRICS, MICE, MCIArb, or equivalent preferred.
  • Proficient in quantity surveying practices, cost estimation, and MS Office.
  • Strong negotiation, analytical, problem-solving, and communication skills.
  • Willing to be assigned in Arca South, Taguig City.

Responsibilities

  • Develop, implement, and maintain the project’s overall claims and dispute resolution strategy.
  • Identify potential claims, commercial opportunities, and contractual risks early.
  • Establish claims management frameworks, schedules, and reporting systems.
  • Interpret and apply FIDIC Pink Book provisions relating to variations, employer delays, third-party delays, unforeseen conditions, and payment disputes.
  • Advise the Project Director and Commercial Lead on contractual entitlements, risks, and opportunities.
  • Lead the preparation and defense of EOT claims and delay analyses (TIA, Windows Analysis, Impacted As-Planned, As-Planned vs As-Built).
  • Demonstrate clear cause-and-effect relationships between events and critical path impacts.
  • Direct preparation of disruption and productivity loss claims (Measured Mile, labor/plant inefficiencies, resource disruption).
  • Assess and prepare claims for prolongation costs, head office overheads, and escalation-related claims.
  • Lead preparation for Engineer’s Determinations, Dispute Board proceedings, and arbitration if required.
  • Coordinate with external legal advisors, expert witnesses, and technical specialists.
  • Support project leadership in commercial negotiations with the Employer, Engineer, and other stakeholders.
  • Provide guidance to the claims, commercial, and planning teams on contractual compliance, claim preparation, and record keeping.

    • Lead the preparation and defense of Extension of Time (EOT) claims and delay analyses.
    • Perform delay analysis using methodologies such as:
      • Time Impact Analysis (TIA)
      • Windows Analysis
      • Impacted As-Planned
      • As-Planned vs. As-Built
    • Demonstrate clear cause-and-effect relationships between events and critical path impacts.
    • Direct preparation of disruption and productivity loss claims, including:
      • Measured Mile Analysis
      • Labor and plant inefficiencies
      • Resource disruption assessments
  • Quantum & Cost Claims
    • Assess and prepare claims for:
      • Prolongation costs
      • Head office overheads
      • Additional preliminaries
      • Disruption and inefficiency costs
      • Escalation-related claims
    • Ensure all claims are supported by detailed records, calculations, and financial analysis.
  • Dispute Resolution
    • Lead preparation of claims for Engineer’s Determinations, Dispute Board (DB) proceedings, and arbitration if required.
    • Coordinate with external legal advisors, expert witnesses, and technical specialists.
    • Support project leadership in commercial negotiations with the Employer, Engineer, and other stakeholders.
  • Team Leadership & Mentoring
    • Provide guidance to the claims, commercial, and planning teams on contractual compliance, claim preparation, and record keeping.
    • Promote awareness of claims processes and FIDIC requirements across the project team.
