Qualifications

JOB SUMMARY:

The Compliance Officer oversees and monitors the Company's compliance with applicable laws, regulations, regulatory requirements, and internal policies across its pawnshop, remittance, money service, jewelry, and other business operations. This role is responsible for ensuring that the Company maintains the necessary registrations, licenses, permits, reports, and regulatory requirements required by government agencies and regulatory bodies.

The job holder will monitor and coordinate compliance with the requirements of the Bangko Sentral ng Pilipinas (BSP), Anti-Money Laundering Council (AMLC), Securities and Exchange Commission (SEC), Bureau of Internal Revenue (BIR), Department of Labor and Employment (DOLE), Social Security System (SSS), PhilHealth, Home Development Mutual Fund (HDMF/Pag-IBIG), Local Government Units (LGUs), and other applicable government agencies.

The job holder will report directly to the President & CEO and Board of Directors and is expected to provide timely compliance updates, identify regulatory risks and deficiencies, recommend corrective actions, and support Management in maintaining a strong culture of regulatory compliance, accountability, and ethical business practices.

DUTIES & RESPONSIBILITIES

The job holder will be responsible for the following:

  1. Regulatory Compliance Oversight

  1. Monitor the Company's compliance with applicable laws, regulations, regulatory issuances, and internal policies.

  2. Maintain a centralized compliance calendar covering regulatory filings, registrations, permits, licenses, reportorial requirements, and renewal deadlines.

  3. Monitor regulatory developments, identify compliance gaps, coordinate corrective actions, and provide regular compliance reports to Management and the Board of Directors.

  1. BSP & Financial Services Compliance

  1. Monitor compliance with BSP regulations applicable to the Company's pawnshop, remittance, money service, foreign exchange, and other regulated financial service operations.

  2. Conduct compliance reviews, branch visits, and monitoring activities to assess adherence to regulatory and Company requirements.

  3. Monitor and coordinate regulatory requirements relating to branch openings, relocations, closures, changes in operations, regulatory reports, examinations, findings, and requests for information.

  1. AML/CFT Compliance

  1. Monitor the implementation of AML/CFT policies and procedures, including customer due diligence, transaction monitoring, recordkeeping, and other required controls.

  2. Review or coordinate the investigation of unusual and suspicious transactions and ensure proper escalation and reporting when required.

  3. Monitor corrective actions for identified deficiencies and conduct or coordinate AML/CFT compliance training and awareness programs.

  1. Corporate, Tax & Government Compliance

  1. Monitor compliance with SEC, BIR, DTI, and other applicable government registration, licensing, tax, and reportorial requirements.

  2. Maintain compliance records and filing schedules and coordinate with the Corporate Secretary, Finance, Accounting, HR, Legal Counsel, and other responsible departments.

  3. Monitor government notices, examinations, inspections, findings, and requests for information and ensure that appropriate actions are taken.

  1. HR & Labor Compliance

  1. Monitor compliance with DOLE and labor requirements relating to employment practices, wages, benefits, working conditions, employee records, and mandatory reports.

  2. Monitor compliance with SSS, PhilHealth, and HDMF/Pag-IBIG requirements, including employee registration, contribution reporting, and remittances.

  3. Conduct periodic reviews of HR and payroll-related records and coordinate with HR and Finance to address identified compliance deficiencies.

  1. Permits, Licenses & LGU Compliance

  1. Maintain a centralized database of Company registrations, permits, licenses, certificates, and other government approvals.

  2. Monitor the timely application, renewal, updating, and maintenance of permits and licenses applicable to the Head Office and branches.

  3. Coordinate permit and regulatory requirements for branch openings, relocations, renovations, closures, and other operational changes.

  1. Compliance Monitoring & Risk Management

  1. Conduct or coordinate risk-based compliance reviews, internal audits, and regulatory assessments across the Company’s business units and branches.

  2. Review business processes, internal controls, records, and transactions to identify control weaknesses, compliance gaps, irregularities, and regulatory risks.

  3. Maintain records of audit and compliance findings, recommendations, corrective actions, and implementation status.

  4. Monitor the resolution of identified deficiencies and verify the effective implementation of corrective actions.

  5. Prepare audit, compliance, and risk assessment reports and upscale significant, recurring, or unresolved issues to Senior Management.

  6. Recommend improvements to policies, procedures, and internal controls based on audit findings, regulatory developments, and identified risks.

  1. Compliance Training & Awareness

  1. Develop and implement compliance training and awareness programs covering applicable regulatory requirements and Company policies.

  2. Provide guidance to employees and Management regarding compliance matters and regulatory obligations.

  3. Promote a culture of ethical conduct, accountability, regulatory awareness, and compliance throughout the organization.

KNOWLEDGE, SKILLS, ABILITIES AND PERSONAL CHARACTERISTICS:
  • Strong knowledge of Philippine laws, government regulations, and regulatory compliance requirements.

  • Strong understanding of BSP, AML/CFT, and financial regulatory requirements, particularly those applicable to pawnshops, remittance, money service, and other regulated financial institutions.

  • Proven knowledge and experience in internal audit, compliance audit, risk assessment, and evaluation of internal controls.

  • Strong understanding of banking and financial institution operations, processes, controls, and regulatory requirements.

  • Familiarity with SEC, BIR, DOLE, SSS, PhilHealth, HDMF/Pag-IBIG, LGU, and other applicable government requirements.

  • Ability to interpret laws, regulations, circulars, and regulatory issuances and assess their impact on business operations.

  • Strong analytical, investigative, and problem-solving skills.

  • Ability to identify compliance gaps, assess regulatory risks, and recommend appropriate corrective actions.

  • Strong organizational skills and ability to manage multiple regulatory deadlines and reportorial requirements.

  • Skilled in conducting compliance reviews, audits, and monitoring activities.

  • Excellent report-writing, documentation, communication, and presentation skills.

  • High ethical standards, professionalism, integrity, and sound judgment.

  • Ability to handle confidential and sensitive Company, employee, customer, and regulatory information.

  • Ability to work independently while effectively coordinating with Management and different departments.

  • Timely renewal and maintenance of Company and branch permits, licenses, and registrations.

  • Timely identification, reporting, and resolution of compliance gaps and regulatory deficiencies.

DESIRABLE QUALIFICATIONS Education and experience:
  • Bachelor’s degree in Accountancy, Business Administration, Finance, Management, or any related field.

  • A background in Law or a degree in Law is an advantage.

  • At least three (3) years of relevant professional experience in compliance, with substantial exposure to compliance monitoring and regulatory requirements.

  • Demonstrated experience in risk management, internal audit, internal controls, risk assessment, or related functions.

  • Proven professional experience in a bank, financial institution, or other BSP-regulated financial services organization is highly preferred.

  • Experience in pawnshop, remittance, money service business, or other financial services operations is an advantage.

  • Relevant professional certifications, such as CPA or CIA, are an advantage.
