We seek a skilled Litigation Lawyer specializing in consumer flight claims, particularly in small claims procedures, to lead in-court collections and potentially open their own boutique legal firm in Italy. Pre-court collections are managed by paralegals. You will file batches of court cases to recover compensation and reimbursements for passengers, including ticket refunds. Our claims include EU261 compensation for delays, cancellations, denied boarding, and baggage claims under the Montreal Convention.
If legal decisions are unjust, we may escalate to seek legal reforms. There are PR opportunities for court victories and legal issues to raise public awareness. This role is ideal for high performers with strong litigation experience and a passion for consumer rights advocacy in the airline industry.
The candidate must be free from conflicts of interest, able to litigate claims against different airlines.
Requirements :
- A valid Attorney at Law license in Italy and professional liability insurance.
- A law degree from an accredited institution.
- Experience with small claims, consumer rights, or aviation law is a plus but not required.
- Knowledge of relevant consumer protection laws and aviation regulations is a plus but not required.
- Proven success in in-court collection.
- Strong analytical, research, and legal strategy skills.
- Ability to manage caseloads, prioritize, meet deadlines, and track statutes of limitations.
- Experience in automating claims management processes to scale operations.
Responsibilities :
- Represent AirAdvisor legally in Italy, handling claims and legal matters within the jurisdiction. Assist in setting up a legal firm if feasible, including corporate structuring and registration of legal counsel.
- Manage pre-court collections and out-of-court settlements.
- Prepare and file approximately 200+ legal claims monthly against airlines for:
- a) Compensation under EU Regulation 261 / 2004 and Turkish SHY Regulation for delays, cancellations, and denied boarding.
- b) Reimbursements for expenses under EU261 / 2004 and the Montreal Convention.
- c) Ticket refunds owed to passengers.
- d) Baggage claims for delayed, damaged, or lost luggage.
- Respond to airline defenses, including procedural and jurisdictional challenges.
- Enforce court judgments and initiate enforcement proceedings.
- Engage in settlement negotiations and represent AirAdvisor in court settlements.
- Maintain accurate legal files, ensuring compliance with legal ethics and data protection laws. Conduct legal research to improve practices.
- Stay updated on consumer protection, aviation law, EU regulations, and relevant judicial decisions.
- If necessary, pursue appeals and advocate for legislative changes.
- Support automation of claims workflows using legal tech and AI tools.
- Identify new civil claim opportunities under Italian law, including low-value, high-volume litigation areas like banking or labor disputes, and conduct cross-jurisdictional research.
- Represent AirAdvisor in media and PR, including interviews and public relations for legal victories or developments.
- Review content to build local trust and authority.
- Advocate for passenger rights within the airline and travel industry.
